Hey all, AirBnB has now updated their policy on emotional support animals BUT there seems to be an exception in NY state… Anyone know a link for the law that would apply to us in upstate NY (I’m not in NYC which might have their own regulations regarding this issue). Thanks!
The other point of debate is whether a private home is a "public establishment". Just because one lists it publicly for rent does not make it a "public establishment", like a restaurant or a hotel, where the doors are unlocked and anyone can walk in and request service. If Airbnb guests have the right to privacy in what they have booked, I don't see how it can be classified as a public establishment.
@Sarah977 If Airbnb is ever officially ruled a 'public accommodation' in the US, that would kill a huge portion of the business. Hosts would then have to have the same stuff as hotels or large apartment buildings...wheelchair access, built in sprinkler systems, more reporting requirements, probably different commercial insurance. I'm always amazed at how bad Airbnb's government relations/public affairs arm is, considering that this is really their Achilles heel. They would be much better off spending the money they spend on feel good PR on lobbying.
