Any advice for dealing with HOA looking to ban AirBnB’s . Have run for over a year with no problems.

The sad reality is that many/most HOAs can change/make their own rules, seemingly on a whim, with little notice. You can try to meet with a council/group/whatever to make your plea (present how you would proceed, how your rules won't cause any bad effects to neighbors, you'll respect a quiet time, etc.). But unless you actually live nearby you will have to prove how you're able to follow through on controlling a situation and that's going to be a major issue with them I would say.  And honestly, when you think about it from the group of an HOA protected neighborhood; people are willing to pay extra to live in a community setting that helps control things for the good of all. So that's what's being challenged by people who buy into HOA homes but don't live there and rent it out. Maybe your situation isn't actual 'the problem' but it's someone else and now you're stuck in the mess as well. Search on this page in the upper left search bar for recent HOA rules; I'm sure there have been dozens of concerns posted from all angles. Maybe you'll gain some inside info there 🙂 on how to deal. Check your contract connected to your house and the HOA to see where you stand at the moment, if they have to give advance notification or whatever so you know how to proceed. Good luck !

Tom, the reason your HOA has suddenly decided to ban STR in your development is a common universal one. This issue comes up frequently and what has prompted it, the property insurer has found out that STR is taking place and are threatening to cancel their insurance agreement with the development.

The insurer does this because by short term renting you have altered the terms of insurance the insurer agree to when they issued a policy.

It's like a vehicle driver comprehensively insuring a car for personal use and then start using it as a taxi.......you have altered the policy agreement, not the insurer!

Short term rental insurance is available but HOA's don't take it up because it is considerably more expensive than general landlord insurance, so when they become aware of it, they simply ban STR.

 

It is unfortunate that many tenants and property owners in developments controlled by a management authority don't get all the required permissions prior to deciding to STR and had you approached the HOA prior to listing your property they would have refused your request.

 

Unfortunately Tom there is not much you can do about it, HOA are over a barrel, they need to maintain insurance coverage on the community and it is easier for them to fight with you than fight with the property insurer.
