I had a guest Injure themselves at one of my listings two years ago. At the time I filed a claim with airbnb, met with an investigator and then heard nothing for two years. A week ago I received a summons stating I’m being sued by said guest. I have filed another claim with airbnb and called every day for a week. Now I only have 12 days until I must respond to the summons and airbnb keeps saying “a specialist will call you back”. I’m scared and don’t know what to do. I don’t own the property so I don’t have homeowners insurance to contact. And since I pay for insurance through aircover it is my belief they are obligated to provide me a service for the payment they receive. Does anyone have experience with this?

After much persistence I was connected with the insurance company that hosts are covered through under aircover. They are appointing me a lawyer and responding to the summons. 
when this first happened the guest did not pursue a suit so there wasn’t anything to chase down. I met with the investigator and it ended there until the suit was filed now.

I'm surprised that when you didn't hear anything back regarding the claim you didn't chase it up at the time @Brandi-And-Joe0 

 

It maybe that Airbnb's insurance company turned down the claim.

 

Surely you would be better understanding what happened to the original claim rather trying to open a new claim.


as you have a number of listings its surprisingly you haven't taken out liability and STR insurance for your business I don't believe not being the owner prevents you from doing so. 

it sounds like you need legal advice so hopefully you are getting this while pursuing Airbnb from an answer on what happened to the original claim. 

have you told the court that Airbnb is dealing with the claim?

 

I don’t know that they are dealing with the claim. I also can not tell the court airbnb is dealing with it. I must have a lawyer respond to the summons and I’m concerned about making a mistake by having a lawyer of my own handle it if airbnbs insurance has someone on it.

 

i worked with the investigator when it happened. I followed up with him and he let me know that he passed it off to them and that was the end of it.

Oh, this is the worst, So sorry about it. Unfortunately, one of my guests had a minor injury during her stay too. First and foremost, her well-being was the priority, and I made sure she received the necessary medical attention. After this, I contacted Airbnb Support to report the incident and get guidance on the next steps. They were responsive and supportive, and provided assistance in managing the situation. I've also reviewed my property for any potential hazards and made necessary adjustments to prevent similar incidents in the future.

I agree I’d never want to be responsible for someone being hurt due to my property not being safe. This situation was a bit different as the guest house as intoxicated and made a wrong turn in the middle of the night while returning to his bed from the bathroom. I made sure to check that the steps, carpet, railing and lighting were all sound and to code and they were and are. But aircover does cover up to $10,000 in medical coverage even when the host is not negligent so perhaps he will qualify for that to help with his medical bills. The situation does make me wonder about utilizing travel insurance when I am traveling as a guest. You never know what could happen

Yeah, I never utilize travel insurance, but you're right. I'm going to take of it asap!
