Is less than 90 days on AirBnB 'commercial'?

Hi,

We have an AirBnB which is a separate building with its own access in London.   When we built it, there was a planning restriction which stated we could not use it for 'commercial' activity.   We researched it at the time and found something that said that less than 105 days does not count as 'commercial'.   We now let it out for no more than the maximum of 90 days per year permitted in Greater London.   However, we have an unhappy neighbour who can't be reasoned with who says we are in breach of the planning permission.   I don't think we are but ultimately it will be for planning enforcement to decide.  Does anyone have experience of this?   Any feedback gratefully received.

Thanks

MG

hello @Marion818 and welcome to ABB CC.

Have a look through the Legal Databases in the UK - because that's where you will find legal decisions where there have been other cases challenged in the legal system.

Also try general search engines like Google using related keywords across the world.

As many have learnt over the last year, many laws are written in similar fashion across the world, however there's always 'Grey areas' which are purposely left open to question laws.

Be mindful also that the 'research papers that have been written and used by Governments claiming that ABB impacts negatively in society is open to questions as to it's accuracy...the same one's who wrote some of those papers are the same "Academics" involved in Public Health telling us our homes are too cold and we need 'Healthy Homes' despite the fact we used to use coals and firewood to heat them & us, along with naturally sustainable & environmentally friendly wool carpet - and in earlier years newspaper to line floors and walls for insulation!

All the best
