Loophole to fight short term rental law

Hello,

 

I am currently fighting Sarasota county on short term rental laws.  Siesta key is a vacation destination and they are only allowing 30 days rentals at this point.  Wouldn’t it be not really a rental if I charged basically nothing for the rental and I only charged the cleaning fee?  $10 is the min you can charge for a night but that would go towards a gift card. Any thoughts?

I own a gated community in Siesta Key with Single family homes.  We currently have 5 homes built and I own the HOA.  Can i as the "HOA" dictate that 7 day (weekly) rentals are allowed within our community?

If rentals are only allowed for 30 days, how come you can still rent air BBs in Sarasota for less than that?

Do any of you all use the app Nextdoor? It is basically Facebook for a smallish area of neighbors. On the 34231 area code of this app the neighbors are going nutso about AirBNB and how to shut us down. I have submitted an application to AirBNB to be a Host for this community because I have a friend who is running for county commissioner. He said we have to band together to offer reasonable solutions from more than just one voice (like Chad said in the opening of this forum). Anyway, takes a couple weeks to get this approved with AirBNB and as soon as it is I will see if we can get together in person or online. Glad I saw found this forum! 

I live in area 34231 There is a air bnb next door...it has been HELL the last month !!! Loud music and noise all weekend.  I'm  sick of it

Bumping old post. But what if you send a month to month lease agreement to the guests that they sign which states they can break the lease anytime without penalty.

 

Wouldn’t  this legally circumvent any of these dumb laws?  They had a lease for a month they decided to leave after 2 days.

That's a question for your lawyer to answer @Elsid1  but I would have thought you wouldn't be able to get away with such an obvious work around . 

I'm on Longboat Key and owned for over qq years now the code enforcement mailed me a notice. How can they enforce this if its not sent certified?? My mail is often messed up, what if I hadn't received this??

 

Any updates on the bill??

Any updates? I don’t want to make any offers on investment homes until I’m able to do short term vacation rentals. Looking in Sarasota, Bradenton or Venice. Thanks

Attn FL residents- the state is now taking up the issue of short term rentals.  Check out Florida senate bill SB1128 and the same bill in the Florida house HB1011.  Call your representatives to voice your opinion.

Hi, Rachel, thanks for the information. It seems to me that the bill will require license to operate vacation home, which will offer protection against draconian local ordinance against short term rentals like AirBnB. It might be a worthy trade of the price is not too high. 

Is this the correct way to look at this?

Hi all! I have read several responses here regarding Sarasota, FL short - term (Airbnb) rules/regs. I live and work in Sarasota as a Realtor since 2013 and have seen the changes in the rental restrictions. I work heavily with investment buyers that purchase properties with the intention of renting them out on Airbnb or longer term.  Sarasota County is extremely strict about its leasing restrictions. In 2019 Sarasota County Commissioners approved a new code enforcement amendment that now allows a fine of up to $5000 to be imposed for violations within Residential Single-Family Zoning (RSF). Keep in mind if there is an HOA in place that has different rules (EX- 3-month minimum 4x per year), that trumps the County minimum which is currently (30 days or 1 calendar month). There is an exception for (RMF) Residential Multi-Family Zoning that allows for "less than 30-day rentals" on the Barrier Islands Only (Siesta Key, Casey Key, Manasota Key). All other areas zoned RMF, are subject to the 30-day rental restriction.

 

Sarasota "City" has different rental rules than Sarasota County. You are able to rent your property weekly (technically= 7 days x 24 hrs + 1 minute). 

 

This information is VERY important to know when purchasing a property in Sarasota County! Most Realtors are unaware of the rules, so be sure to ask questions and do some research yourself.

I would suggest host have some common sense rules for their rentals. Next to me is a air bnb rental...it's been HELL  the last month with different party's every weekend!! If you live and work in Sarasota it's no fun living next to these rentals.  Just another side to this issue
