AirBnb Cancels a reservation because of breach during stay and guest doesn't leave

We had a guest check in who had one positive review but only one letter for a surname.

 

I asked the guest at check in to read the written house rules and sign. He did. 

 

We rented our entire appartment to the guest who booked for 2 people (apartment accomodates 4 and all guests after 2 must pay).

 

Stopping by the next am and looking to the apartments balcony, I could clearly see four chairs in a semi circle outside and a big waterpipe in the midlle of the 4 chairs (two chairs had been brought out from inside).

 

I sent an SMS to the gust and asked him to:

 

1) Hide the waterpipe behind the Air conditioner (our house rules clearly sate no smoking and if must - only on balcony with ashtray.

 

2) Confirm if there had been 4 PAX in the apt and if they had over nighted. Two hours later  - no reply or movement of the waterpipe everyone at the pool in the 350 bed complex can see.

 

Up I go and SMS the guest I am knocking at the door. Guest's partner states he's not in but another guest is. Yes, there were four overnight.

 

On check in, guest had declined to pay the listed and signed for early check in fee.

 

They hid the waterpipe and I modified the three night booking from 2 to 4 people on the website.

 

I wrote in the thread gust to accept the modification or cancel the booking. Then I rand Air BnB and explained the above

 

Guest declined the modification. I wrote in the the guest we were giongto effect cancellation, rang airbnb who advised me not to cancel and airbnb cancelled on the guest's 3 night booking.

 

Now the guest refuses to depart. We went by, they are not there but the belongs for four PAX are

 

What should I do?

Call BNB and ask their advice.. But if the accommodation is cancelled they have no right to be there.

 

They will therefore be charged 2 X or whatever BNB's conditions say for staying once booking is cancelled.

 

Have you called the guests to ask them to return to pack their belongings and leave?

 

Do you have an electronic key system - can you change the codes?

as @Helen3 says, they have no right to be there and are thus trespassing.

See what Airbnb says, but you could also call the police and ask what your rights are.

Otherwise I would send them a message via the message thread saying they are staying unrightfully now and that they have x amount of time to clear out otherwise you will remove their belongings from the apartment and do x with their suitcases.

 

In this case I've read another host's advice several months back that advises to video your entering, how you found the space,  and packing their things together as proof you didn't steal or throw away any of their belongings. Best take somebody with you.

Or better - ask the police about this when contacting them.
