How do I delete my participation in Airbnb? Just got a warning from my apt. manager.

My apt. manager just told me that the owners had a meeting and are about to release a letter stating that if residents in my building start to sublet on Airbnb their leases will be voided and they will be asked to move.

 

Two questions. Is that legal?

 

And how do I delete my participation in Airbnb?

It's most likely legal if your contract or home owners agreement prohibits sublets.

 

You can go to your listing maintenance page and at the bottom left, snooze or deactive your listing.

As mentioned by @Ed-and-Hugh0, what they are doing could be very legal your lease at risk... 

 

You need to read your lease agreement and your local laws to make sure subleting is legal/ilegal... after that you need to pounder if any fight is worth...

Hi Joel, 

 

The Gen manager at my apt complex sent me a warning yesterday too and I host in Venice, CA. Upon reviewing my lease, there is no verbiage that states no room-sharing or hosting is allowed or can be marketed on 3rd party platforms and websites. 

 

The agreement states "Resident shall not sublet or assign this Lease. Any purported assignment or sublet of this Lease or the Apartment Home without the prior written consent of Landlord is null and void."

 

Technically, I am not subletting or assigning the lease to anyone. I still carry the full weight of the lease and simply sharing a guest room in my 2bedroom apt.


I don't see how this is in violation. I temporarily Snoozed/Unlisted my Listing until I figure out how to deal with the situation.

 

Are you going to cease listing or dispute them?

@Joel11 @Joy4 - technically you are sub-letting as you are allowing another person to stay at the property you rent, and charging them. You might also find somewhere in your lease that it refers to 'not undertaking any commercial activities' such as running a business - and your airbnb 'holiday let' could be considered a business and thereby commercial activity.

 

I guess that they will be concerned about short-term tenants with who they have no agreement, causing damage to the property or communal areas or nuisance to other tenants.

 

Sorry but it sounds as though they'll make you cease your ABB listing unless you can reach an agreement with them. 😞
