Your lack of support to thousand of guests who were forced to cancel reservation in order to respect Mr Macron’s lockdown is affecting dramatically your image worldwide.
We need you to convince hosts that are refusing to refund the money when cancellation was due to the restrictions on travel.

La loi française est très claire.

Les arrhes sont dus.

L’hôte est en droit de vous poursuivre et de poursuivre Airbnb si vous ne respectez pas le contrat et il a 100% de chance de gagner.

 

Airbnb n’est pas au dessus de la loi et lui demander de faire des choses illégales montre un aspect inquiétant de certains voyageurs qui pensent n’avoir que des droits et aucune obligation.

 

La location touristique avec arrhes est la norme.
La location touristique sans arrhes est l’exception.

 

Vous pouvez louer une annonce avec des conditions d’annulation flexibles ou payer avec une CB assurance incluse type Amex qui rembourse en cas de restrictions de voyage gouvernementales.

 

La prochaine fois lisez l’annonce au lieu de demander au site de faire des choses illégales.

@Hélène-Et-David0 .  @Nathalie-Et-Gilles0 has articulated the law in France. Now in England the law is very different in that if it is illegal to host a guest then the host must return all their money.

If Airbnb are to succeed then they need to follow the applicable laws for any particular listing. I don't think we can blame them for not liking a particular countries laws.

If she booked in England, it may be different.
Obviously, Airbnb and hosts have to comply with local laws.

To be specific, if you book in France a professional rental (hotel), commercial law is applied.
If you book someone's house (wich is the case of the majority Airbnb's hosts), civil law is applied.

There is a legal difference  beetween acompte et arrhes (Advance payment and deposit ).
Unless specified a flexible cancellation policy, if there is cancellation Advance payment and deposit are due.

If nothing is written in the contract (which is impossible on Airbnb as a cancellation policy must be chosen), the common law declares that it is a deposit.
