I brought this up on another thread, but wanted to revist the issue now that the guests are actually on my property. Its a complicated situation, so here goes
1) Female guest booked a room with herself and one guest for 20 days
2) Right after the first booking, a male booked himself with one guest for twenty days
3) It turns out, after asking both some questions, they are guests of eachother. The female has as the second person the male who then, at the 21 day point, then starts his own booking for 20 days with the original female as *his* guest
4) I went into my Airbnb account after talking about this orignally and gave a one day block off window between bookings to stop this from happening again
5) BUT- the end result of this is that these two people will be in the property for 40 days, yet they split it with two reservations between the two of them for 20 days a piece. The second guest on each booking is also unnamed (just a generic grey head and the word "guest") although they admitted to me the plan was to do back to back reservations and stay 40 days
I am getting very wary of this and I think they might be getting ideas to simply stay in my property after the 40 days. The female even made an off handed remark that they might need to stay until March. Am I protected here or should I take action right now before thsi goes any further (they have been here fior one week so far).
@Sarah977and @Clara116 - I've gone over that conversation about staying until March in my mind. The female brought it up and doesnt speak good English. I think the intent was to ask would the room again be available in March. Right now it is blocked off in reservations for the rest of February and into March becuase I am changing the light fixture and also the county has said they want to inspect it for local short term rental certification. Another thing I forgot to add in the previous post is that I have the ability to lock the refrigator. So, essentially, they would be without power, water, or a place to store food if they tried to stay in the home.
I actually think they are legit at this point, but I guess we will all find out in mid February.
@Anthony608 As I understood, each reservation was made for 2 guests, with each being made under each's individual accounts.
If the reservation was made for 2 guests, no, the woman would't be trespassing or in any way illegally in your home when the reservation is under his name.
@Sarah118-You are right while the reservation is going on he is allowed to have one guest (and it happens to be her). Its after he leaves that it becomes interesting. Since airbnb doesnt have a name for the guest, the county has said there would be no way to prove it was her. She could say she had been living there as his guest, but my response would be I simply hadnt seen her and as far as I know she had checked out in January. When I talked to the county about this, they said that would be the way to go and the law would be actually be on my side.
The simpliest thing of course would be that they are legit and just leave on the day they are supposed to.
@Anthony608 When a reservation is made for 2 guests, one of those people isn't the other person's guest. I did mention that to you before, on your original thread about this, but you don't seem to understand. They are both YOUR guests. He couldn't for instance, have someone else stay instead of her without your permission- that is not how it works. It isn't up to the guest's discretion which people are the 2nd guest once they have made the reservation. A guest who booked for 2 couldn't have sister Susie stay the first night, cousin Fred stay the second night, nephew James stay the third night. No way.
What do you mean, Airbnb doesn't have a name for the guest? Didn't she book 2 weeks under her account? Of course they have her name. And when you accept a reservation for more than 1 guest, you should be requiring the full name of all the guests.
@Sarah977on the booking for each, it shows thier name with an additional greyed out head and simply the word "guest". The female's registered booking is for January while the male is in February. During that time they are both listed as having an extra person, but Airbnb doesnt show the name. I had to contact them individually about that, which was how this all got started when I thought they were being squirrelly. They then both told me what they were doing and actually were very open about it.

What I meant by the intruder information was that, since the female guest's booking ended in January, there is no record of her having a registered booking after that once the male started his booking. So, if she were in the home AFTER the male himself checked out in February she would be an intruder. They could go to court and fight it, but I dont think they would go that far. In fact, I am just hoping they leave as planned on checkout day.
@Anthony608 If either of them overstayed beyond the reservation, no matter whose account the booking was made under, they would be tresassing. Him or her.
@Sarah977- Thank you so much for your advice. Hopefully this will all be for nothing and they will leave on time without any issues.
One thing that completely escaped my mind was that if they stay on the property after checkout the homeowners association will tow thier car. Possibly within as little as one hour. So thats something else that would occur if they attempted to overstay.
Ehhhh..... Did you get their passport photocopies!!

The verdict is...they **DID NOT*** try to overstay on the property and claim residency. Left this morning without a problem. Gotta say, I am very relieved. They were polite and good guests, but one thing I do have to share is that in the last 72 hours of their stay I think they were sizing me up to ask if they could stay longer.
A lot of odd questions about what would happen if they stayed a few hours past check-out time and could they maybe come back the following week and stay during March. My answer was that the room was booked with other guests and also there was a contractor coming to the house to do some work on the room, so no.
I will give them a favorable review, but deep down under it all, my gut feeling is that were going to try and extend their stay if I had seemed open to it. when I made it clear I was not, they left on time.
