To all Legal Airbnb hosts in the city of Las Vegas...

 

On April 11, 2017 at 6pm at 495 S. Main Street, 2nd Floor, in the Counsel Chambers, a proposed amendment is going before the commissioner to severely limit Airbnb Hosts in Las Vegas, which could possibly put many of us out of business. 

 

For example, currently our business license allows us to rent out homes and condos, up to 4 bedrooms, non-owner occupied. The proposed amendment states only 2 bedroom, owner occupied dwellings will be legal....That means only one bedroom can be rented out, and they are limiting it to two people per bedroom only.  There are other changes as well, but just that alone will put many of us out of business. If this passes, all of us with legit business licenses who do not meet this criteria, will have to apply for a special use permit costing $1030. The city will notify all your neighbors within 1000 sq ft about your request. We will then go before a public hearing and if your neighbors show up and complain, we are pretty much denied...and you don't get your money back.

 

I spent about 45 minutes yesterday at the City of Las Vegas Department of Planning talking with them, getting details, trying to understand why and what we as hosts can do about this. The planner said more than the hotels, it is because of the neighbors of airbnb rentals who are complaining that this amendment is being proposed. A few have ruined it for the rest of us. I have never been to a hearing and asked if the public really does come and his words to me were "the last 3 meetings the public has come with pitch forks about this issue." He advised to be prepared to speak and plead our case and rally as much support as we can. He said to speak with your neighbors to find out their view on your rental. If you can, have them come to the hearing to show support. He also advised that this is the most important hearing about this issue, this first on the 11th, because if there is no support or argument for the side of the hosts, it will just go into effect at a certain date. If there is enough host support, there will be more hearings or possible changes for the proposed amendment.

 

Please spread the word to other hosts that you may know. Please talk with your neighbors and most importantly, please come to the hearing. We need your support.

The proposed short term rental amemdments have been taken off the agenda for the  hearing tomorrow, April 11th at 6pm and is going to be postponed to a later date. When I get more information or updates, I will post. I hope this is a good sign for us hosts!!

HOUSE,” REVISE REGULATIONS AND REQUIREMENTS PERTAINING TO SHORT-TERM

RESIDENTIAL RENTALS, AND PROVIDE FOR OTHER RELATED MATTERS”

 

We want to thank everyone who showed up to our meeting on Saturday, April 29, 2017.  We had an excellent turnout.  Thank you to everyone who offered to volunteer for future events!!!

 

On Monday, April 24th and Tuesday, April 25th, our attorney Jay Brown, Julie Davies our STR spokesperson, and Annette Fiala, had individual meetings with City council members, the mayor and Karen Duddleston from Business Licensing.  We feel we made significant progress on several of the proposed issues on the amendment that will be read into the minutes on Wednesday, May 3, 2017.

 

It is not necessary to show up to this meeting on May 3, 2017 as no one is allowed to speak at this meeting.

 

We need everyone to mark your calendars with this date:  Monday, May 15, 2017 at 10 AM.  This will be the absolute most important meeting regarding your rights affecting Short Term Rentals for the City of Las Vegas and Clark County.  Whatever gets adopted in the City, will typically be some form of what gets approved in the County assuming we can finally get the County on board.  Which we do remain optimistic.

 

Whether you have a property in the City of Las Vegas, North Las Vegas, Henderson, Boulder City or Clark County, this will eventually affect you.  We are advocating for a universal ordinance to be adopted in all of Clark County so all the rules and regulations are the same.  There might be some specifics to each city or municipality, but the core ordinance will be the same.

 

We need a minimum of 100 people to show up and if we have 200 people, there is no way they can ignore the numbers.  Please don’t be alarmed as there will be opposition showing up also, as this is their only chance as well to influence the Recommending Committee.  The opposition will be brutal !!!  Do not take it personally.  Just stay focused and remember to be respectful.  There is no particular order in which we will speak.  Jay Brown will probably introduce us and then we go from there.  If they have 10 opposition speakers, we need 100 positive speakers.  It’s all a numbers game.  Content is very important of what we say.  We definitely don’t want to waste any speech time.

 

Right now, the council members are taking significant heat on passing STR’s and they are not wavering on requiring a SUP (Special Use Permit) for 2 bedrooms or more AND requiring a 660 foot separation between any approved units.

 

The problem is, they have not approved one SUP or application for the 660 foot separation,  effectively banning 2 bedrooms or more STR’s.

 

We need everyone to show up on Monday, May 15, at 9:30 AM to:

2nd Floor (Recommending Committee meeting room-West side of building)

Plan on being there until at least 12:30 PM.  Please park in the parking structure located across the street.  Bring your parking ticket with you, and they will validate it at the check in area for the meeting.  Please stop inside the deli located in front of the bottom of the parking structure to pick up a T shirt that we will all be wearing that will identify our group from everyone else.  You may keep this T Shirt.  Please wear it to every meeting going forward to identify you as part of our group.  Please invite your family and friends to show up as well.  They do not need to speak.  We just need numbers.  If you are not able to attend this meeting personally, still please invite everyone to show up and we will give them a T shirt as well.  Please collect the T shirts back from everyone unless you know they can come to the next meeting.  (Wash them and bring them to the next meeting to hand out.)  Please invite any contractors who work for you on your properties.  Landscapers, cleaners, pool guy, repair guys, caterer, anyone and everyone.  If they are articulate, please have them write up how not having a STR would affect their job and income and we ask everyone to limit their speech comments from 1.5 minutes to 2 minutes unless you have a super impressive compelling story.  It is very important to not repeat anything someone has already said.  You may start with:  “I agree with everything already said here, …” and then say what you want to say.

 

Please write out your comments.  It is very easy to get tripped up if you haven’t written it on paper.  You are welcome to read it.  Please do not say anything in a negative tone.  You will end up discrediting the whole group.  Find the positive spin on your comments.

 

We basically get the first 5 seconds of our 1.5 minutes to impress the “Recommending Committee”.  You need to start with something that they have never heard before. A personal story/experience is good.  Remember, they will be listening to a lot pf people, so we need to impress them.

 

Any presentations on the SUP and 660 ft. requirements are what will help us on those points.  We do need all the stories and presentations, so please put some thought into your comments.  Feel free to email Annette for editing or help once you have written it.  LOL…and please don’t wait until the Sunday night before the meeting.  She will be busy!!!

 

If someone has a lot of comments and would like to type them up to hand out for others to present at the meeting, that would be appreciated also.  Please forward those to Annette so we don’t duplicate.

 

For those of you who are not familiar with the Recommending Committee, it is made up of 3 council members who listen to everyone and everything presented (as this is our last chance to change minds prior to a vote for adoption) and then they decide what, if anything, they will consider changing going forward.

 

We won’t know what agenda item number we are until the week before, so I will text everyone when we get that info.  Plan on being at City Hall from 9:30 AM until at least 12:30 PM.

 

Since Annette receives hundreds of calls, if you have a quick question, feel free to text her for a faster response.  Email is the second best contact and phone is the last resort.

Please see that attached Nuisance Ordinance adopted in 2014.  We recommend you place a copy in all your properties and consider attaching it to all your lease contracts to help avoid possible problems with future renters.
