New airbnb ohio building code and ada

Hello. My wife and I are building a vacation  cabin in Ohio for our family.

 

It's a 2 bedroom custom ranch at  1600 sq ft with an unfinished walkout basement.

 

We have planned on renting it out as an air bnb anytime our family is not using it.  When aep went to run our electric they told us we needed a commercial building permit since we will use our home for transient rental per 2017 ohio commercial building code section 3.10.3. On transient rental.

 

So we called the state and they confirmed that if we will rent our vacation home we must have a commercial permit. They now want us to submit engineer stamped plans to the state for review and want us to stop our home construction.  They say that this also requires us to comply with ada compliance according to the state of ohio which may require us to modify our build plans during this review.

 

Has anyone else with an air bnb in ohio experienced this.   

 

At this point we have contacted an attorney to help us through this.

Sounds like you need a planning consultant rather than a lawyer. 

in the UK we always need to submit plans to build property  to our local government to apply for planning permission - is it not the same in the US? 

We are experiencing the same thing.  Building a cabin and wanted to abide by the regs and building codes.  We have had 7 months of delays now waiting on plan reviews and approvals.  The dept of commerce seems to want to treat it like a hotel instead of a single family rental.  Feel like we are being punished for wanting to do the right thing.  We have seen multiple other cabins built and rented out while we have been waiting (guessing they were built as "vacation homes" and then rented out)
