I am a new host to Airbnb. I have my first contact interested in renting. I don't see where I attach my Rental Agreement for them to execute. I don't see a place to do so. Deborah

I really like this idea. I have been making them still sign an agreement after they pay but this might be just as easy. How would this work with people who are not instant booking though. Do they still have to read and agree to all the same questions? I do have probably have of my guests that are not instant book because they have questions and will ask them before booking therefore are not instant booking.

@Dianne-And-Brian0 Yes, I do require that everyone acknowledge they read my house rules / Rental Agreement and 'Other Notes', etc when booking, no matter how they book. And I do this all on the Airbnb messaging system. This helps Airbnb to support me if a guest wants a refund. If they did not really read it and agreed to something they never actually read, that is their problem, not mine. And I have never yet lost a booking because I do this. I screen pretty well, and most all my guests (with only two exceptions) have been very pleasant and responsible people to host.
You better check with an attorney in your state before you give out that advise to everyone. Posting a notice and asking if they read it is not the same as a rental contract that lays all the terms and conditions out and you both sign it.

Thank-you so much!! Trying to set up an Airbnb listing for my condo.... It certainly would be nice to have Airbnb improve their system on this item .... but this workaround is an excellent answer until they do. I too have a condo HOA rental agreement to contend and comply with as well as Rules and Regulations regarding guest behaviours in the complex. I might add a line at the outset to say ...in the event of a discrepancy in provisions between the Rental Agreement and the Airbnb guest contract, the more restrictive provision will apply ... or something like that. I only had to read the first sentence, that will not be binding rental agreement as you can even require a click to accept the terms! Here's some info that will help you.

A Rental Agreement DOES NOT need to be signed in order for it to be binding under NC VACATION RENTAL ACT.
You can simply add in the description or notes:
"PAYMENT OF MONEY AND TAKING POSSESSION OF THE PROPERTY FOR SPECIFIED TERM AFTER REVIEW OF OUR RULES/POLICIES, IS EVIDENCE OF YOUR ACKNOWLEDGEMENT AND ACCEPTANCE OF AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL UNDER NC VACATION RENTAL ACT."
As long as this is disclosed ahead of time, you'll have the added peace of mind and be covered.
Most contracts=do not have to be signed to be legal, however in many cases a signed contract really helps with clarity.
The main problem is that such legalities are often location specific and what might be valid where you live may not be where I live.

North Carolina's Vacation Rental Act protects consumers who rent a vacation property for fewer than 90 days. Under the law, the landlord or real estate broker must give you a written rental agreement that spells out: Your rights and obligations as a tenant, including what you'll pay.
first thing that is for the state of NC and it still says the landlord is to provide a written rental agreement. This is more for the protection of the renter not the landlord!
