QUESTION TO VACATION RENTAL IN GERMANY / BERLIN

Hello guys can you help me because I m confused : we live in berlin and we applied at city hall to get a vacation rental verification but we got the answer NO - just from 2 month up we can rent our place which is the whole downstairs apt in our house - we live upstairs- city hall said Berlin needs the apt to rent for long terms because the apt market is small 😞 but we see people renting in our neighborhood even for a couple of days or weeks and we want to do the same but not sure …..? Maybe you guys can help in terms of that how it could work for us without any consequences. Thanks Airbnb family 🙂 and stay healthy Siggi and Sergio !

Some short-term rentals exist with older permits that were granted when a finite number of them were made available by some districts. Others may be exempt from the terms of the law because the rental space is less than half of a shared living space (including a shared kitchen and bathroom).

Airbnb doesn't always require hosts to submit a valid permit in order to have an active listing. However, you should be aware of the fact that Airbnb submits all Berlin hosts' reservation data to the city authorities and the Finanzamt, which guarantees that there will eventually be consequences if the listing is not permitted.
