There out of control in the Florida Keys, Monroe county Florida.Mile marker 6 to 106. They not even giving you warnings. If your not zoned for weekly rentals they fine you immediately (most zoning is 28 days ). I just got fined 2nd offense is $15,000. For first time offenders they calculate weekly rate x 4 weeks is your fine. So if you rent $3,000 a week fine is $12,000. They fining at least 20 hosts a month. Fort Lauderdale it is okay weekly just have to be licensed by the city.Code in Monroe County said they collected $650,000 in the past year. Hosts beware of immediate fines!
The past 2 years the Florida legislature has failed to over turn the law. First it was allowed 2011 to 2015, then in 2015 Governor Scott reversed the law and allowed cities and counties to do any laws they wanted. So past 2 years no new law has been passed.
A lot of owners want to build and based the construction loan on the weekly rental. Now if they cant rent weekly they are not building so it will hurt the local home builders. Maybe if economy takes a downturn and taxes are needed maybe cities and laws will change? The state and local entities are going to lose a lot of business.

You call it out of control. Those of us who try to make a full-time life down here in the Conch Republic think it's about time. I think the last statistic I heard is that 60 percent of the real estate in the Keys is owned by out of area owners/2nd homeowners. People like you come down here, buy all of the remotely "affordable" housing, and try to skirt the rules that have been in place for well over a decade and turn your places into party houses for those who like to scream until 3 am (when the locals next door have to go to work at 8 the next morning.) We have to bus in people from Homestead to work in hotels because there is nowhere for them to live. Teachers, first responders, etc. can not affore to live down here any longer because peple like YOU are pricing them out of the real estate market. The powers that be have been dealing with this problem for so long that they know full well a slap on the wrist/warning does NOTHING. That's why these cases go directly to fines now. And NO, forcing people like you out will not hurt the economy one bit. People who rent your place don't support restaurants, shops, etc. They bring everything with them, eat Cheetos and drink beer for a week, then leave all the trash by the side of the road and head back up to the mainland. Sorry, no sympathy here.

Where you get your facts from?I send my guests to all the local restaraunts. How often do the homeowners go support a restaraunt? Once a month?And to top it off your great powers that be the leaders are allowing big box stores like home depot,Mcdonalds and Dennys in the keys. This going to put local restaraunts out of business.
They lost 1000 mobile homes in Hurricane Irma, Keys reporter news online I saw this. Even worse the county is charging $7,000 plus in building fees.So a mobile home owner wants to build another trailer. Wait, building code says due to flood insurance a new home must be built on stilts ,this costs over $100,000 and a one story home on top is minimum $150,000. So show me one service worker who can afford to build this home and pay the mortgage or rent it???That why you have to bus workers in,no one can afford the county's building fees. Just check the building permits, it all public record,look at permit fees.
So your telling me that service workers at Dennys and Mcdonalds and hotels or home depot, winn dixie and publix can own and rent homes in the keys if there are no vacation rentals? Get real ,where you been?It is the homeowners and leaders pricing workers out of the market.
We hire cleaning serices too. So the law says only 28 day minimum and not 7 days anymore. So the workers come down to clean once a month instead of4 times a month. No wonder they live in homestead. They cannot rent a home in keys if they only work once a month
So let me get this straight from your powers that be. Vacation rentals is bad for local businesses because they pack lunch and dinner and eat at the home. Your probably correct that 60% owners are out of town.So why you living in the keys, it clearly is a tourist destination. Your forgetting that vacation homeowners are paying the majority of the property taxes too. They have no homestead exemption like a local owner.
But now the code is shutting down 40 rentals a month. That is no 6% sales taxes for the state or 5% tourism taxes for the county.So that is not hurting the local economy one bit you say?Close 440 vacation rentals a year will not hurt the economy you say? Maybe it can help disney and Universal.
So if they want new roads,they raise the property taxes. And the vacation homeowner pays more as they have no homestead exemption. So an owner has a cap of 3% if property taxes go up and a non-homestead it is 10%. So an owner taxes go up $300 but a vacation owner goes up $1,000 .So will this cause rentals to get cheaper in cost? Or do you think the rents are going higher? It appears that the leaders are raising property taxes more on the 2nd homeowners and vacation owners. This causes prices to go up and rents too. We have no control over prices and taxes, the local residents vote the leaders in and you make all the laws. We dont have no voting as we are not homesteaded owners. So blame is on you,the local conch republic.
Here is the problem you will never fix. If you are not able to get along with your vacation rentals because they disturb you. Well who do you think is buying the homes in the keys? I just sold to a nice latin family from Miami-dade. I had one boat,they have 3 boats. Three other homes have been bought by latin families. If you want to see a party with 100's of guests,than this is what you have now. They come down and party all weekend. The local residents are reporting them. The code says,they not on airbnb or homeaway there is nothing you can do. So if the county feels that all vacation rentals are bad . Well wait until the new homeowners arrive and move in next to you. Just check code enforcement. Local residents are calling in complaints all the time. Now they complain about noise but since it not a vacation rental there is nothing you can do. I guess you can call the police for noise.
And finally if there are no weekly rentals ,only monthly, no 3 day rental guest can come to the keys anymore. Good thing Disney has a 3 day pass,tourists can go to disney. When vacationers are closed down,they will go to other destinations. In a few years the Gratiny Miami Lakes super mega mall will be open in Northwest Miami-Dade county. Tourists can go here too.

I'm with you in all aspects. Real estate is so expensive in the keys. Short term rentals allow for both; another place to stay that is not a hotel as they may also be filled to capacity but allows for a more individual private type of atmosphere for those who seek it. Also, the cost of real estate doesn't allow for the homeowner to maintain the property as he should based on a min days x the cost of insurance, taxes, mortgage general cost of utilities and still going up. Therefore, min should be adjusted to allow home owners to be able to maintain their properties properly and have the income to do it with as well. Mind you, to maintain a 28 day or even a 7 day rental on such expensive properties is almost not worth the effort.

They are indeed still out of control! I have NEVER rented for less than 28 days but somehow my minimum time got changed from 28 to 21 days and we are being fined! I don't recall how this was done or even doing it but as soon as we were notified with the certified letter, we changed it immediatly. Our rental records show we do NOT rent less than 28 days and have paid our taxes appropriately for all of our renters. AirBnB or direct! This is so ridiculous!
