Hey,
I booked an apartment from 7 - 12 October and when I got there I found guests already In the apartment staying until October 14th and when I asked they said they canceled it but when they found out that there's no refund they decided to stay.
I have tried to contact the host but he doesn't care and said I should cancel it as well so that he doesn't have to return refund.
What am I supposed to do in this case and how can I get a refund because the place apparently isn't available and I haven't stayed.

@Osama150 You need to contact Airbnb urgently and ask them to sort out this mess. The contact details should be on your reservation. Hopefully the host will be removed from the platform for this ridiculous behaviour.
What you should not do is cancel - This is the responsibility of the host/Airbnb.

I contacted Airbnb at first after they contacted the host they said the previous guest might leave tomorrow so how about we book you a place for tonight and then you come back tomorrow to the apartment. I refused of course because this is not convenient and asked for a refund, they said they will contact the host again and get back to me but I am afraid because the cancelation policy states that there's no refund.
I booked the apartment in Warsaw, Poland.
@Osama150 Call Airbnb again and hope you get a sensible person. The cancellation policy is irrelevant as the host did not supply the apartment when it was booked. Sadly support is pretty poor for guests and hosts but eventually you will find a sensible employee.
I called them again after your advice.
They have issued a refund.

@Osama150 Ring Airbnb customer service immediately . This requires a full refund at the very least and I believe restitution as far as other accommodation is concerned. Report this host. Those guests have no right to stay if they have already cancelled and the host had no right to rebook if they had not left. They should not ever have had access.The host sounds as if they have taken leave of their senses... H

@Osama150 if you had to pay more because of the failure of the host to supply your booked apartment then you should ask Airbnb to contribute. The host should have got a fine so they can afford it.
@Osama150 I am glad you have the refund Osama. Restitution usually takes the form of a paid stay somewhere else , so there is probably no point really but do ask , while your case is still open as it seems there should be something.. H
