Legally speaking you can’t take money for goods or services that you then refuse to provide, except in very rare circumstances.
She wanted the money but she didn’t want the guest. It just doesn’t work that way, nor should it.
I have owned and leased various rental properties since 1974 and I found, to my great surprise, that once you let someone into your house you may find it nearly impossible to get rid of them. Even if they trash the place. Even if they don’t pay the rent. Even if they threaten you with violence.
Landlord/tenant law is based on ancient feudal customs, is complicated and is constantly changing. In 1500 AD things were pretty nice for the landlord. More recently, not so much.
Airbnb can’t evict people for us. They may be on shaky ground even if they try to cancel a booking.
A contract has been formed with the necessary elements of Offer, Acceptance, payment for something of value, and a time limit. Proving a breach of contract is not easy and Airbnb doesn’t have the legal standing to do it on behalf of either the host or the guest.
The fact that Airbnb seems to be willing to terminate the contract on behalf of guests with questionable complaints to the detriment of the hosts is disturbing however.
This should work both ways.
If a guest or a host desires to terminate the contract early it can be done without Airbnb’s approval but neither party should be allowed to profit from it.
Guest wants to leave early? Leave. If Host is able to mitigate losses by renting to someone else then Guest should be refunded proportionately. Otherwise Guest should take nothing as long as the property is available to them.
Host wants to get rid of disagreeable Guest? Tell Guest to get out and tell Airbnb to refund the money for the unused days. Host will pay a penalty in accordance with their contract with Airbnb.
Guest refuses to leave? The Law doesn’t want to get involved. It’s up to Host to motivate Guest (non-violently.)
There are many legal ways to do this. I won’t go into details but if you use your imagination. . .
28 outgoing phone calls and 316 minutes later, they finally canceled the reservation, suspended her account, and asked her to leave immediately. - it’s been over 24 hours and she is still here. She won’t leave because AirBnB is refusing to refund her despite me agreeing to the refund and begging them to do so. They offered her one night at a hotel and I was going to do the same, but that’s not good enough for her. So now bc they won’t simply refund her for the remaining days, I have to retain an attorney and start the eviction process. So basically, it’s worse and I’m even more stressed out than before. I’m just exhausted! I spoke to the police, and like I predicted earlier, they won’t help me until she hurts me. They could care less about her harassing me and violating our agreement. She’s been talking about “her rights” quite a bit…yay!! Go California!!!
@Kaylee41 Call the locksmith to change the lock and throw her things outside. This is the only way.
You may need to wait until she goes out or call a few male friends to help you.
@Kaylee41 I'm confused, why would Airbnb refuse to refund the guest for nights not stayed when the host agrees to a refund? Are you sure you aren't talking about Airbnb refusing to refund her their fees?
@Kaylee-D-0 Hosts always have the option of refunding a guest- Airbnb doesn't have the last word on that. You use the Send Money option in the Resolution Center.
