New rental rules in Spain

Does anyone who hosts in Spain have any idea how the new "rental laws" affect Airbnb listings?  

 

To my understanding, if I rent out my house in Spain I have to jump through a load of hoops, such as obtaining a rental number from the local town hall, having air conditioning and heating fitted and reporting all guests to the local police station within 12 hours of their arrival!

 

Is Airbnb caught up in these new laws or is it outwith?  

 

Any comments or suggestions with this would be gratefully received.

the "best" part is when you invest on one conditions. And then in some years the government totally changes the rules and starts to dictate its own conditions. I agree with Natasha - totally communist or so call socialist ( fake ). Who are these people to tell you what to do with your property? Why they have a right to tell you to whom and in what conditions to rent or not rent at all?  What if all is good with neighbours and stuff- everyone is happy - guests, owners, neighbours - but Government is not ( like almost in all spheres when middle class people start to win money). I don't beleive that poor spanish people suffer so much from tourists, it's so fake story - majority of friends I know rented out their properties and rooms and were happy about it. But hey, spanish government even lets ocupas take YOUR PROPERTY - I mean..no comments. Yes, we have a choice to sell apartments and not invest in Spain anymore ( as middle class people)/ But hotel businesses will only grow as they definetely have a lobby with EU politicians

We also live in Catalunya, and we are renting out a whole flat, but as it is part of a duplex (its complicated, but we have 2 flats, one above the other, with separate entrances, registered as one.), the Ajuntamiento said we DIDN'T have to register it - registration was only for WHOLE apartments.  I called the generalitat in Girona, and this was confirmed. ( I am waiting for it in writing of course).

 

(There is an option when registering with AIR BNB, which says something like "We are exempt from registration because we are only renting out a room/part of a property" )

 

If I hear more, I'll let you know.

hello, I would like to open an airbnb room on the costa tropical andalucia, are the controls (registration, taxes,...) frequent and severe ? many trials and fines (high amounts,....) thanks 

Tourist licences are now obligatory here in Andalucia, (I too am on the Costa Tropical). In addition, from July  all the rental platforms ABB,TA HA etc are obliged to report your earnings and number of nights to the Tax Authority here in Spain, so you have to declare all earnings from this year 2018 because the tax man will already know what you have earned.  Part of the controls are the need to report the passport details of each adult guest to the Guardia civil within 24hours of entry (just as Hotels have always had to do) and  Yes they do/can spot check this.

Go to the main office building in Malaga with someone who speaks Spanish the 8 floor. If you town is more than 20,000 population as for the form for  urbanisation. If the population is less than 20,000, ask for the form RURAL even if it’s one house in the countryside. Note both the above forms are the same rules that apply to the new 2016 tourism law. Fixed Air conditioning throughout and including bedrooms with fixed heating. Windows in bedroom with blinds. Fire extinguishers. First aid station. Map of were you live showing medical center police & fire with phone numbers emergency 112. And the hosts phone numbers and e mail. Then go to the Garda civil and ask for the guests forms names of guests passport no’s if or driving licence. Photocopy all and duplicate the forms 1 for 1 for the police and get your copy’s stamped and keep for 3 years. Or go on line within 48 hours and send the police the information. All guests must be show how to use everything including the safe workings of the wood burner and everything in the kitchen. You need fire alarm,& CO 2. Emergency exits and instructions on how to use the extinguisher to only use as an aid to escape. Anti slip strips were needed. Penthouse Rosa Villanueva de Algaidas Malaga Spain. I am planning to register tomorrow in the office. Is it the one in Av. de la Aurora? My question is if a little Spanish would be enough to communicate with them. What questions will they ask? And do I need to have proof that I have Air Conditioning installed like a bill or something? Or is my word that I have it enough?

I am in your same situation ... I rent a room in the house where I live. I do not have many guests, because I live in the countryside, we work and having a little girl, I choose very well who I host ...
I have been reading the new tourism law that comes into effect on July 8 and, the truth is, it is not clear to me at what point are the people who do not rent the entire house, but only one room ... Do you know something else? ?

If you use Air BnB you fall into this category ... "Obligation to register your property if you rent it out habitually .... You commercialise the property by using ´channels´ aimed at tourists, like booking sites"

 

I would assume that renting out one room falls into this category unless you can confirm with the relevant authority that this is not the case.

Does anyone know how long it takes to get the registration number for a property?  My paperwork was lodged with the Ayuntamiento (Cordoba Province) early May and I've not heard anything yet.

Upto 3 months I was told by my local adjuntament. But you are legal to rent as soon as you have applied and paid the fee. (although this doesn't really help with airbnb etc who insist on you entering the reference number)

I’ve just read that in barcelona the city has inforced a new rule/law to get airbnb to reveal host’s personal data from the 1st June. You’ll also need permission to list your property with airbnb otherwise the city will report you and have your listing removed. Anybody with details how to register with the city (procedure, costs, requirements, timeline....etc)? as i have bookings for june, july and august.
