Town zoning violation short term rental

Hi Community Center!

My neighbors complained to the town about my Airbnb activity, and I just got a letter stating I violated zoning and needed a special permit.  I live in Wayland, Massachusetts, USA.  I haven't called the town yet, but does anyone have experience with this, or can you refer me to someone?

Checking whether the area you want to operate your STR business in has STR regulations is a key step every host should take when setting up their business. 

It sounds like you are lucky that your local government haven't immediately slapped a large fine on you for not having an STR licence.

 

1. I am sure you've done this already but the first thing you need to do is don't take any more bookings . Now you are on notice they are much more likely to fine you . 

2. read through the STR regulations on your local government website to see if you are eligible to apply.

 

 If it's a yes that's good news. If not -  you may not be able to operate - or may need to operate in a different way. 

I am sure the letter you were given tells you what to do.

 

Hi @Helen3  and thanks for your reply. I registered with the State of MA here in the USA, got the "Room Occupancy Excise Registration Certificate" in June 2003, and started renting in October. However, over that time, a couple of guests went to the wrong home on my street, and the neighbors got concerned recently and complained to the town of Wayland. Wayland notified me today via mail that there were zoning issues, 10 days to cease, and special permits were needed.  I wanted to be prepared before I applied to my town for the special permit and I blocked future bookings for now.

@Tom4843. Hi Tom, I found this doc online. I'm no expert but it looks like STR changes are on their way to Wayland:

Critically it says on page 2 The Town of Wayland is planning to restrict short-term rental to those with a 30-day minimum stay. The Planning Board can approve ADUs larger than 900 square feet by special permit. Once approved, an ADU must be constructed within a two-year period.
