Recovery of loss from a guest who broke my TV

I had a guest who claims she left a window open in my apartment which she said caused my television to be knocked off the tv cabinet and break beyond repair. I made a claim to recover the cost of the television from the guest however it was rejected on the grounds that the damage was caused by a storm and therefore an “act of nature”. I have appealed the decision 3 times & each time I’ve been advised that the original decision to reject my claim has been upheld. Has anyone else experienced a guest using this clause “act of nature” to preclude them from paying for an item they have damaged or broken?
