regulations in oakland california

Hi, I am new to hosting.  I am looking at buying a home in the piedmont pines area of oakland california.  this is a residential area.  this would be a single family home that i would be occupying.  there is a nice, private unit in the downstairs that has a bedroom, a full bathroom, its onw living room, and its own private entry.  this is however very much a part of the home and does not have a kitchen.

 

the potential income from the airbnb unit is critical to my ability to afford the mortgage on this house in the long term, and i need to make a decision soon.

 

i am looking over the laws and regularions in oakland regarding airbnb's and they are very confusing.  can someone just tell me if it is legal or not to rent out an airbnb in this area in oakland? 

 

there are a lot of airbnb's nearby in the same area, so if these are not legal, how do you pull it off without getting busted?  

 

and if people are just dong it and not getting busted for breaking the rules, do you still pay taxes?  that seems like it would be like mailing the county a letter and telling them "hi, i am breaking the law, oh and here is some money!"

 

this is all very confusing, any help is appreciated thank you.

It is currently not permitted to rent a room or home or any unit for fewer than 30 days in Oakland, CA. The law is enforced when someone reports an offender to the Planning Department. You can look the reg up on the Oakland Planning department website. It absolutely bans Transient Rentals which is defined as 30 days or fewer. There are no exceptions, except for hotels. 

 

In 2016, the City Council passed an ordinance asking the City Planning Department to write regulations that would allow people who live in their homes to do rentals for fewer than 30 days. The law was never written and it remains as it was before the 2016 ordinance. If anyone else has any information on this, I would love to hear it. @Michael2866  Cheers
