Hello,
I am wondering if anybody else rents an apartment in Spain and could advise me as to how to submit documents required by law under the new 933/2021 decree throughout Spain enforceable from 2nd December 2024?
Hello @Mary6784, Thank you for bringing this topic to our community.
The Spanish Community Center has seen a lot of activity recently, with hosts sharing their thoughts on the new regulations in Valencia.
I found one conversation posted today related to Royal Decree 933/2021, which you can view here.
I’d recommend posting your question in the Spanish Community Center here. This way, our Spanish hosts, especially those in Valencia, can share their insights and opinions.
Regards,
Hi @Paula. Thank you for that. I clicked on the Spanish community link you sent over so hopefully my query has been posted there and I will get some feedback.
I wonder if Im the only one having an issue?
My apartment is in Benalmadena, Malaga. I have an NIE but I am unable to register on the SES.HOSPEDAJES: The new traveler registration platform.
Is anyone else managing it?
At this point you can only do it if you have a "Certificado Digital" which you need to request online, identify yourself personally in certain governmental offices and then download it to your computer. Once you have it, you can create your account in SES.HOSPEDAJES which is, as you say, the new platform for reporting.
I have enquired to the Ministry of Interior because the law indicates that non-professional user CAN register and report offline, but I believe nobody put together a process to do so.
This was the less thought through law they could come up with. Written by some clerks that never booked a holiday for themselves or paid online before... just good-old cash or physical credit card at a hotel reception or travel agency.
SES.HOSPEDAJES includes the possibility to indicate that the reservation was paid at "PLATFORM" but the law does not indicate that possibility... quick and cheap fix 😉
Thanks all for the quick reply: Disappointed that such a poor process can have significant implications for errors, like EUR 600+++
My issue with Ses.Hosp website is that when I select the option "Access to the registry of establishments and entities" and I try and register with CL@ve, I put in my NIE then it asks for "It introduces the number of support of your foreigner card, EU citizen residence permit or certificate" I am (unfortunately since Brexit) not an EU citizen.....
I cant seem to go any further.
There are certain things that can't be handled just with Cl@ve but you need Certificado Digital. This is one of them because once that you have introduced the data you need to digitally sign it and that can only be done with Autofirma, which only accepts Certificado Digital.
I wrote a general enquiry asking how to proceed with foreign owners that do not have a Certificado Digital, specially that the Royal Decree indicates there should be and offline way to handle the whole process
I'll keep you posted
Hello, where are the rules for professional and non professional users? I do not know which am I...but even if I am non professional can do everything (report my guests data) via the digital platform?
Do you operate with a NIF or as "Autónomo"? Then you are professional. Do you use your normal NIE and report your income when you fill in your tax return the year after? Then you are not professional.
@Tomasz119 Even if you are a non-professional host, you are still required by law to submit some personal information about your guests. See Annex I B: https://www.citizensadvice.org.es/documenting-tourists-arriving-in-spain/
Hope this helps.
If you are interested in discussing this with me, I am a journalist investigating the policy for an international media piece and I would welcome your thoughts as a professional/non-professional host, whichever you are! Thanks, Dan
Hi Mary,
I hope you have figured this all out. If you would like to speak about your experience as a host, I am looking into the Royal Decree for a piece for international media. I'm hoping to get people talking about this issue here in the UK as I don't think it's very clear what the policy is and what it means.
Let me know if this interests you, no worries if not! Dan
