I rented out my home under a long term rental (yearly) and during this time my tenants listed and rented out my home on Airbnb . I was unaware and apparently so was my former property manager. I found out because the City where I live sent me several Notices of Violation. The City requires you to register your home and have a license to operate short term vacation rentals.  I have made several attempts, asking Airbnb to assist with providing additional information confirming the information provided to me by the City is correct so that I can pursue a claim for damages. They have not provided any assistances or support in this matter. I am posting this here, hoping that someone could provide some guidance as to how I can obtain information of rental/payment history from Airbnb.  I have been calling and emailing customer service since Jan 2023 when I received the first Notice of Violation. Does anyone know who can help?

 

My home was damaged beyond wear and tear and there are other issues regarding the security deposit that will have to be resolved in court. So any and all documentation provided would help me with this situation.

Hmmmm....

Couple things : does your lease forbid the tenant doing short term rentals?  Do you have a lawyer? It would seem that you and your tenant have some legal matters to sort out. 

Yes, I am aware.  No my lease does not allow for sublet or any persons other than the tenant to occupy the property.  I need help on how to get Airbnb to assist with providing more information. thanks.

What did the tenant say when you raised this issue with them?

 

You can take screenshots of the listing as evidence they are sub-letting.

 

Speak to your lawyer for advice on evicting the tenants as they have been sub-letting and reclaiming costs associated with them doing so.

 

Have you gone onto the listing and reported it as an illegal listing?

@Iniabell0 there is a form that law enforcement can use to get information from Airbnb. It might be worth seeing if a lawyer could use the same form. I suspect not (and assume there is no law enforcement involvement) so this may be an entirely unhelpful response.
