Shared path to private garden

Hi folks,

I want to build a cabin in my private garden for airbnb use. There an issue of a shared pathway between myself and neighbour. The path leads to BOTH our gardens. Does anyone know where I stand legally on this? There is no mention of the path or access in our lease.

@Jess6164 try downloading, if you don't have them, the deeds of the property. If there is no mention of the path anywhere then you may not have access yourself!

I think you will need planning permission for commercial use (check with the planning team at your local council) @Jess6164 


I wonder if your neighbours would need to be consulted if the access path is shared .

 

do have a look at the deeds to see if there is anything around access? 

there will be a 90 day limit.

Thanks Emilie. It's really tricky; there'a lease from the 70s and an updated one, but it's not clear if the original lease terms are still honoured. Original lease says not to use garden for anything but private use. The building is now share of freehold. Probably need a lawyer to look at it

That sounds like a good idea, those documents are quite difficult to sort through so getting a professional's eye on it can only help!
