Granny flat/ Annexe planning

Hi does anyone know if I can rent a previously used  granny Annexe that comes under as ancillary use in the planning paper work. I know I am not allowed to rent this out to a tenant as in a permanent let. I

am hoping I could let it under the status of a lodger ie short term holiday let’s.

I have searched Google and there is responses saying yes/no.

 

would I need to get a change of used for holidays let’s ?

Hi.. I had to apply for a change of use and resubmit plans. 
It was accepted and is now classed as a holiday let.

@Sam4847  Local laws vary. This question does not have a general answer- it would be specific to your area and you haven't even said where you are located.

@Sam4847 I would just do it and beg forgiveness if the council complains. If there is access to you house then it could come under the 'rent a room' scheme even if you lock the access door.

If  it is a separate dwelling just be mindful that you will have to pay capital gains tax on that part of the property for the proportion of time you are running it as a business.

my planning statement for granny annexe concern below 


The living accommodation [annex outbuilding] hereby permitted shall not be
occupied at any time other than for purposes ancillary to the residential use of the
dwelling known as ##########
Reason In order to prevent the additional accommodation being used as a separate dwelling
SAFE WELL PROSPEROUS CONNEC
which would have unsatisfactory facilities for prospective occupants or would have
an unsatisfactory relationship with the existing dwelling, having regard to Policies
DS1 and DS5 of the North Lincolnshire Local Plan and CS5 of the Core Strategy and
the National Planning Policy Framework.
The materials used in any exterior work must be of a similar appearance to those

Hi Sam .. just wondering if you found out about this as I have been letting mine out on Airbnb  it’s an ancillary annexe as well.. and council have been in touch as breach of planning but I haven’t spoke to them yet.. just wondering were I stand

As others have said it varies by council @Lena-Kim0 

 

What restrictions if any are in your courent planning permission.

 

If you have restrictions to only residential use only your local council can tell you whether you're likely to be successful in applying for them to be lifted.
