Advice on dirty property, refund and outcome

Hi all, I need a bit of help along what to do next. 
I booked a three night stay at a property, which was a 8 hour drive from where we live. When we arrived at the house at around 4pm, there was a nasty smell coming from the kitchen. We assumed it was just the last guests cooking. After unloading all our bags and having a look around the property, we noticed that things that were advertised and shown in the photos where either no longer in the property, or were different to how the photos made them looks. For example, the kitchen table in the photos, shows a hamper basket, bread, biscuits, tea, coffee, flowers etc along with a clip board with the house rules, WiFi password etc etc. The table when we arrived, had a laminated a4 sheet on, and a plastic book containing restaurant info. No hamper, no bread etc. The lounge was missing books on the bookcase, plants, wood and bits for the fire, pictures on the wall. The kitchen was missing the clock, pictures, etc also. There was a bowl of teabags and sugar, and a pint of milk in the fridge. In the photos it shows nice bottles of handsoap and washing liquid, but there was 1/4 fairy washing liquid bottle and a used bottle Handwash. All the rugs downstairs were dirty. The entrance hall door was dirty, the doormat dirty and scuffing at the sides. The electric meter on show with wires hanging out the side. The sofas dirty and scuffed. Two stains on the rug. The footon thing up on the sofa. The stairs were so steep and were not advertised that they were a potential danger hazard, or so steep for those who would be unable to climb. The top of the landing was so narrow, and could easily fall down the stairs as no stair gate or rail. The bathroom shower had black mould in the showers heads, along the sides of the bath and in the corners. Under half a roll of toilet paper. No handsoap, shower gel, bath soup etc again as shown in the photos and advertised. The sink unit had toothpaste splats all over it. Yet there were clean bedding and clean towels, rolled up and placed neatly on the beds. The cleaners had obviously been in but were doing a half heated job. So after everything I messages the host who said that a changed over was not done and admitted it being her fault. I tried explaining that I think a change over had been done, but not done properly. By the time we exchanged messages it was around 7pm, by which time we had headed out to dinner, and on the way back bought some cleaning products as there were none left in the property for us to use. You would think in the middle of a COVID pandemic, antibacterial sprays and handsoap would be available. The host did try and get the cleaners to come in, but having a 1 year old baby, it’s not so easy. We told her we had bought the cleaning products and would clean ourselves. She at this point said she would reimburse us for the first night. After an awful nights sleep in a rock hard bed, we got up and headed out for the morning. When we returned, the smell from the kitchen was getting worse. After having a look around, we discover that it was coming from the fridge. When we pulled the fridge out, red liquid split everywhere and what we can over describe as a fishy, gone off, disgustingly foul, something has died, smell empowered the kitchen. Something had obviously been spilt in the fridge and been sitting in the overflow tank for sometime. My partner cleaned this up. I sent photos to the host who was apologetic but that was it. At that point I deceived to email Airbnb as had read about emailing them within 24 hours. The host at this point had also messaged to say if we wanted to leave, she would fully refund us for the rest of the stay. We made a decision there and then to leave and we drove home, arriving at 1am. The next morning I messaged the host to say we had left and will await a refund. Two days past and I hadn’t heard anything so messaged her asking what was happening. Since then I have not had a single reply from her. After speaking to Airbnb, they sent a refund back for the first night. But what about the other two nights. So after numerous emails and calls, I got another refund through, but for a random amount. So I called Airbnb again to find out what was going on. They are now saying that the host is saying we stayed for 1 night and won’t refund for this night. Even though I have messages from her in black and white saying she will refund us fully if we leave. Now she is saying we stayed 1 night, which I am not sure how as she doesn’t live in the area. Now Airbnb are agreeing with her, again I am not sure how. Rather then them saying they can’t confirm if we stayed for 1 night or night, and agreeing to split the balance in half, they have gone in the hosts favour. So the amount outstanding is £251, yet we paid £190 per night, plus £60 plus fees. Airbnb have already said they would issue a coupon for the fees which are £71, but are still charging me for the cleaning, even though no cleaning was done and the host accepted liability for this. So I’m still at a loss. I have requested this go to a manager but am so far still waiting. Help!!!

@Jess3640 if all your messages are on the app you shouldn't have a problem getting a refund. If they were text messages then it will be a lot harder. Perhaps just try messaging Airbnb again to see if you get a better Customer Support rep.

Hi @Mike-And-Jane0 thanks for the reply. Yes all messages via the app. Even though the host states in there numerous times if we leave she will issue a refund, Airbnb are saying that’s not the case. They have had the emails showing she has messaged this, yet are still not issuing the money.

@Jess3640 How bizarre. Have you tried a Twitter approach? Apparently Airbnb don't like washing dirty laundry in public. did you leave a suitable review?

@Mike-And-Jane0  I haven’t tried anything else as yet but Twitter is a good shout. I haven’t left a review either as want to get this sorted before I do.

@Jess3640  Is it possible you forgot to cancel after you left?  Meaning the host couldn't re-rent the place, maybe this is why she changed her mind on the refund, that's all I can think.

 

I'm curious, are you sure it is the same apartment that was advertised?  I ask because there have been scams where a beautiful place was put on airbnb, but the actual unit is totally different.  

 

Airbnb application of their own rules is pretty random, but I would guess if you have the time and energy you will eventually get if not all the refund you're asking for, at least most of it.

 

The best way to work with Airbnb is to cut and paste the relevant parts of their own rules, so for you it would be the TOS on host standards and amenities...then in very short, direct sentences, outline the evidence that the host was out of compliance...attach photos, etc.  

 

Do the same for the refund...refer to the message from host on the refund, screen shot and attach.

 

Make all your communication with Airbnb based on the idea that the customer service rep's goal is to do nothing and the only way to prod (s)he to do anything is to make the case for them.

@Mark116 thanks Mark! We left the property around 5pm Friday night, which the host messaged about an hour before that to say if we wanted to leave she would refund. We arrived home around 1am, so I waited and messaged her first thing Saturday morning as I thought this a more respectable time to say we left to which she cancelled the trip. I didn’t cancel as didn’t want to get charged or have anything go against me for cancelling. 

I just can’t believe Airbnb have gone in her favour, after the host admitting liability to the cleaning issues, all the problems and missing items, then messages confirming we could leave and she would issue a refund. I don’t understand how they can do that. Not even agree to go halves on the 1 night she thinks we stayed, which we didn’t. There is no proof on either counts. But they are going with her word. It’s not right!

This is really a disgrace and I think you should get an apology and a refund.

 

 I hope you don’t conclude that all, or many, Airbnb rentals are like this. They’re really not.

 

 You should keep complaining until you receive what you are due.

I understand the host cancelled the reservation on the next day ? Then the remaning nights will be refunded.

@Emiel1   Those procedures were followed. Both travel issues and the guest refund policy. 

yes the host cancelled, but has only given us back 1 night as a refund, even though she agreed the whole 3 nights

would be refunded. That’s why I am arguing with Airbnb as I have in writing from the host she would fully refund if we left the property. But Airbnb are now saying she doesn’t agree to it.

@Jess3640  Usually, when the guest is not satisfied with the accommodation some hosts would offer a full refund FOR NIGHTS NOT SPENT AND CANCELED. This way the calendar is open again for someone else to book.

If you stayed 1 night, and waited another night before you canceled then the host will refund just the third night. I've never heard of any host who would refund used nights or nights not canceled- You obviously misunderstood your host.

 

Regarding the accuracy of pictures in the photo gallery.... they are staged for photo shooting. You can see glasses and a bottle of wine on the table ... but it doesn't mean it will be there when guests check in. Maybe even the table will be different because it was broken and replaced in the meantime.  The professional photo shoot is not simple or cheap and the last time we did it was 5 years ago. Since then we removed some decorations to make cleaning faster and easier due to Covid, some things were ruined so we had to replace them with new ones in a different color, we changed a few framed pictures as well ...  but we didn't take a new photoshoot after each of these small changes. Nobody does. It's Airbnb and things don't last for long. However, we would take new pictures if we would change the beds, armchairs or sofa, color of the walls,  the entire kitchen if we would remodel the bathroom or do some other, significant and important changes.

 

 

 

 

 

 

@Branka-and-Silvia0  Thanks for your comment. the host, up until 4pm on the Friday evening, told us if we wanted to leave she would issue a fully refund. I have confirmation of this my message from her to me. She wouldn’t have been able to open up her calendar again for that night anyway. I definitely have not misunderstood anything. Just because I didn’t cancel there and then is irrelevant as there would have been nothing should could do about relisting for that night due to the time. 

Regarding the photos, I am fully aware that they are staged photos, but when the description and photos match and fully state what to expect and the property in real life is different, how is that right? If it states a welcome hamper, you expect a welcome hamper. If it states the property is fully equipped for your stay, how is under a quarter of a toilet roll fully equipped? Or shower soaps etc. If you states this is the description which this place did, and was not there for us when we arrived. How is that correct?
I get that things get broken etc but to completely not replace them, like empty shelves in the lounge where a whole bookcase was full. Mirrors on the dressing table. A wood burning stove, but nothing to be able to use it. Cushions and throws on both sofas and beds, but nothing there. No home comforts whatsoever.  
to say this place was ‘staged’ is an understated, the place was empty!

That isn't how it works. If a guest arrives to find the place unacceptable, the guest needs to cancel and leave. I don't understand what you think you would have been "charged" or how you think it would go against you. These instructions are there for guests to read on the Airbnb site.

 

As long as you fail to cancel, and you don't see a cancellation confirmation from the host, you still have an active reservation. The host's calendar remains blocked, and they can't rerent those dates.  

 

You have to understand that if the booking is not officially cancelled, Airbnb has no way of knowing if you are still  staying there or not-it would be your word against a host's.

 

In this case, it sounds like this place should be closed down, not rerented, but the procedure stated above is how to go about things.

@Sarah977  I didn’t cancel the stay straight away because the host was replying to my messages, had confirmed that there was an issue with her cleaners and the change over so said she would reimburse the first night. After an 8 hour drive, and arriving at 4pm with a baby, you just want to get in and settled and not have to worry about anything. 
After spending the first night there and trying to communicate on messages, and even at 4pm the Friday night, the host still confirms if we wanted to leave she would fully refund us. If she was happy stating that in the messages then that’s good enough in my eyes, that if we leave we can expect a refund. Just because I didn’t click the cancel button there and then, shouldn’t make any difference. Yes if it was 8am in the morning, I can fully understand that, but it was 4-5pm on a Friday night. I messaged her at 8am Saturday morning to say we had left, to which she cancelled the reservation. But then didn’t receive a refund for the Saturday night. Even though she cancelled it. How is that fair? And to now not reply and end all communication is just rude and inconsiderate.
