@Anonymous can you provide more details? How long did she stay for? Is she communicating with you Have you contacted airbnb? Normally for short term stays and depending on your local laws she is now a trespasser and can be removed by police or a security company
She was removed by police. Is threatening to sue me. She was here 2 months. Reservation ended Saturday June 6th at 11am. I emailed her checkout instructions 3 weeks ago. Never could get Airbnb —1 1/2 on hold. Police said there is no protection against being sued because Airbnb doesn’t have law enforcement approval. In the meantime I have an autistic child in house as well as my wife. This guest is a Traveling Nurse.
My plan is to contact State Farm Homeowners Insurance tomorrow as well as Lawyer.
@Anonymous On what grounds is she suing you? A lot of angry people rant about filing lawsuits but very few end up doing it once they realize the time commitment and potential costs.
I’m sorry just so blown away by whole experience—she never said exactly why she wanted to sue.
@Anonymous Is this the same 2 month guest you posted here about who was walking into your bedroom, plopping herself down and telling you all her problems? The same one who rearranged your entire kitchen in the middle of the night her first night at your place? You posted here about her and got a lot of responses- most advised you that she sounded crazy, that there was no way that you should let her reservation continue and that it wouldn't end well if you allowed her to stay. If you are going to ignore advice you ask for, it's a bit strange to then ask what to do when you decided not to follow any of the advice. Sort of wasting everyone's time here, I'd say.
I was going to ask @Anonymous similar questions about the guest, because it does seem that she's posted stories about the guest before.
In Georgia, usually a renter becomes a tenant after 30 days, and a 60 day notice to vacate is required. The state does require more to establish residency, such as a bill for a service at the rental location. Since the guest was informed at the time of reservation that she would be required to leave after two months, she was simultaneously given a notice to vacate. In this situation it appears that the rental terminated at the contracted time, and this period just also happens to have encompassed the 60 days. In this situation, I doubt that the disgruntled guest has any legal standing against @Anonymous.
I tried getting her out multiple times. Airbnb said ‘talk to her ‘. She wouldn’t talk without exploding. Finally a friend recommended calling police. Dispatch recorded her ranting and raving. That was at 2 month mark.
@Anonymous You are a little sparse with your details of the situation so it is difficult for other hosts to be helpful. Was she requesting to stay longer and you either did not want to or could not accommodate? She was in the space for two months and therefore might be considered a tenant, not a guest.
Sorry I’m still processing everything that happened. I was so stressed out I ended up in hospital for 4 days.
I would look into rental laws in your state & local jurisdiction ASAP. Talking to a lawyer is a good idea. She may be a tenant, not a guest& have a different set of rights. Seriously, long term lets are very very different & I would never, ever rent to someone without getting references & doing a credit check & asking for a security deposit. Tenants have to be legally evicted, not removed as trespassers. This may be an expensive learning curve, best of luck.
Verbally she said 3 months but only booked with Airbnb 1 month at a time. Ultimately staying 2 months.
I mean no disrespect to anyone. This Guest was a Bully. It seemed impossible to get her out. She was not receptive to anything I said until Law Enforcement was called 2x. Airbnb won’t answer my calls or texts. I asked her to leave she said she wasn’t leaving. I packed her things for her and called Law Enforcement. Overwhelmed....Traumatized. What started as a 3 month reservation ended at 2 months. You can see her review of her stay as well as my response. I made changes to my listings. Yes it’s a Learning Experience. Luckily I’m a Survivor and have another guest coming Sunday. Thanks for the ‘Support’.
Also, she only booked one month at a time. We had multiple misunderstandings and it was unclear if Airbnb had miscommunicated—rates, rehoming etc. A friend of mine said this Guest had a mental illness and gave me tips about how to work with her. Every time I tried discussing issues with the Guest she became defensive and excused herself (To bathroom or work). She worked nights and slept days.
