Yes, you need a separate golf cart insurance policy as well as a signed release of liability signed from guests. Home owners insurance won't cover it if the golf cart accident was not on the insured property. Here is mine:
GOLF CART WAIVER & RELEASE OF LIABILITY
PLEASE READ CAREFULLY BEFORE SIGNING
In consideration of being permitted to use a golf cart on the property of Kiva Dunes & 7190 Blue Heron Cove, I, the undersigned, for myself, my heirs, executors, administrators, assigns, & next of kin, hereby acknowledge & agree as follows:
- Assumption of Risk: I understand that the operation of a golf cart involves inherent risks and dangers, including but not limited to:
- Collisions: With other vehicles, pedestrians, objects, or terrain.
- Rollover: Due to uneven terrain, sharp turns, or excessive speed.
- Injuries: From falls, ejections, or contact with the cart or its components.
- Weather-related hazards: Such as rain, fog, or strong winds.
- Malfunction of the golf cart: Including mechanical failures or tire blowouts.
- Animal encounters: With wildlife or domestic animals.
- Release of Liability: I hereby release and forever discharge Kiva Dunes, the Holladay Family, its owners, employees, agents, and any other person or entity associated with the property, from any and all claims, demands, actions, causes of action, damages, losses, or expenses of any kind, including but not limited to personal injury, death, and property damage, arising out of or in any way connected with my use of a golf cart on the property, whether caused by negligence, strict liability, or any other legal theory.
- Indemnification: I agree to indemnify and hold harmless Holladay Trust, Dana Holladay Fallentine, Robert Holladay & Kiva Dunes, its owners, employees, agents, and any other person or entity associated with the property, from any and all claims, demands, actions, causes of action, damages, losses, or expenses, including attorney's fees, arising out of or in any way connected with my use of a golf cart on the property.
- Compliance with Rules: I agree to abide by all rules & regulations regarding the operation & use of golf carts on the property, as may be posted or communicated to me. The operator must have a valid driver’s license.
- Age and Condition: I certify that I am at least 18 years old & in good physical condition to operate a golf cart.
- Insurance: I understand that I am responsible for any damage I cause to the golf cart or property while operating it. I may be required to provide proof of insurance coverage.
- Entire Agreement: This agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written. All persons utilizing the golf cart must use seat belts.
- Governing Law: This agreement shall be governed by and construed in accordance with the laws of the State of Alabama. It is important to understand that excessive speeds will cause the golf cart to roll or tip over.
- Severability: If any provision of this agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
I have read and understand the foregoing waiver and release of liability and agree to its terms.
