TAX ID delay

Hello,

 

I started my listing in France this month. I didnt put my TAX ID yet because it takes about 3 months to receive it once request. I get continues emails saying this:

"We know this is a busy time of year, especially for hosts, but it’s important that you take a moment to read through this email.  Our tax team noticed that there’s a compliance matter regarding your account that needs attention.

To adhere with DAC7 hosting platforms like Airbnb are required to collect tax information from hosts and co-hosts based on where they reside or have listings. Your account is missing one or more taxpayer ID numbers.

Please provide your Tax Identification Number or SIREN Business identification Number at your earliest convenience."

 

 

Can somehow airbnb wait till I have my TAX ID. My co-host that gets all the money has already included the TAX ID>

Did  you apply for your SIRET number on www.inpi.fr Andreas? It normally takes 7 days to receive your SIRET number and this should be done within 14 days of starting your business.  

 

 

Hi Joelle, I am not going to setup a business. I am renting as an individual. 

What's I dont have and I am  getting asked is NIF because this is my first year in France. Therefore once I got asked I have applied to get the number and I will get it in 3 months.

 

The listing does not belong to me officially but belongs to my partner (we are not married).

If the listing belongs to your partner then I presume that when the listing was set up, she was declared as being the primary host and not you?    I'm seeing you as the host and Gaëlle as the co-host which doesn't seem right.  It should have been the other way round. 

The revenue generated from the rental of the room will be directly transmitted to the tax office and if the property is in Gaëlle's name, then it is her NIF that is needed as the owner of the house.  She can then pay you a % for co-hosting the property but if the listing hasn't been set up properly, this might be an issue.

Is it possible to transfer her as main host?

Co-host has full access. And my I am the primary host. I live in the house permanently too.

Who is registered as the owner though?  

I think its me because I am the one I set it up. Does owner mean legally owner or does it mean co-living since we are partners.

If your partner has been able to enter her NIF and she is the one that receives the payments then hopefully the money she receives will automatically show up on her tax form.  If this is not the case and the money shows up under your tax form then you and your partner will have to amend your separate tax forms when they come through and explain the error to the tax office.  All of this can be done on line.

I had this problem at the beginning when the earnings from the Airbnb stays showed up under my name (I am listed as the host) in our joint tax form but should have been entered under the company name which is registered on our Airbnb account also.   We explained the situation to the Tax department, changed my earnings to zero and declared the amounts under the company name. No problems since!   That's the tax part.

Now for the Airbnb part: The way that the listing has been set up means that if you and your partner go your separate ways then the reviews will stay with you, not the legal owner as she is only a co-host even if she has full access. Reviews stay with the person who sets up the account and are non transferable.

I don't see why that would complicate anything Andreas - that's just a personal arrangement between the two of you.  

 

Airbnb will declare the earnings to the tax authorities and it remains to be seen if that will be done using your profile or your partners with a way of amending if necessary beginning of 2026.
