Crazy Neighbor complaint Airbnb

We rent through Airbnb our nice, fun, upgraded home in suburban southern California.  It rents mostly in the summer; families like it because we have a pool with waterfalls and a grotto.  We have some fun animals, such emus, and a professional movie theater upstairs.  With the additional quirky fun things that come with the house, we receive extremely positive reviews.

 

The home is on a 2 acre private lot.  But...we have this neighbor down below.

 

She lives in her house which she inherited from her father.  It is a disgusting mess and she has been repeatedly fined by the county for living in unsanitary conditions (rats, cockroaches, etc).  For the past 30 years, well before Airbnb, she would call the police frequently when I had kids in the pool playing, or if I have friends and family visiting.  She complains to the county about speeders on the street, and the FAA RE airliners noise (we are 50 miles from LAX).

 

RE my Airbnb.  This summer she was successful in complaining enough, for Airbnb to pull us offline.  We produced to Airbnb all the documentation, and Airbnb agreed with us and restored us online.  Apparently she is relentless with her complaints (Only she has complained, no other neighbor), that they just pulled us off again.  They (Airbnb) said they will restore us; however, if she complains again, we are off permanently.

 

I would like to sit down with a human, bring in my documentation, and once and for all, put this to bed.  She is CRAZY, who gives her the right to shut down my, much needed, side business income.  

 

How do I defend myself to Airbnb?  Does anyone out there know?  And don't say negotiate with the neighbor, been tried.  No kidding, she is CRAZY.

@Vince1315 Some random ideas

1) Obtain a court injunction to stop her complaining frivolously to Airbnb?

2) Send her a legal letter saying you will sue her for losses associated with loss of Airbnb income if she gets you pulled from the site with her frivolous complaints

3) set the emu on her (hmm perhaps not)

@Vince1315  Another idea- get a lawyer to send a letter to Airbnb making it clear that this neighbor is crazy, listing all the city violations she has been dinged on, her constant complaints to the FAA and police about speeders, etc. Have him make it clear that these complaints have nothing at all to do with your guests disturbing the neighborhood and that no other neighbors have ever complained about your listing. That if Airbnb removes your listing because of bogus complaints from a mentally disturbed individual, they will be taken to court to reinstate your listing.

(There is precedent for this- a host took Airbnb to court when they had delisted her because a guest claimed she had a gun by the front door- there was a gun- not a real gun and it was in a box of dog toys. The host, after a protracted legal battle, had her listing reinstated.)

Going legal is my last resort.  In California, "going legal" as a private citizen vs Big Business is highly expensive.  If you 'win', you actually lose; because you will have spent 5 years of profits to get back to start.

I'm looking for an avenue for a "sit-down" with an Airbnb decision maker.  Is this possible?

No there isn’t a way for disgruntled hosts to have face to face meetings with Airbnb - If there was hosts would be queueing around the block 🙂 

is there any validity to her complaints about guest noise? Do you have restrictions around when outside space can be used? 

 

Your choice if you want to stay with Airbnb is to talk to the neighbour or take legal action.  Why would be be expensive to ask a lawyer to write a ‘cease and desist’ type letter?

@Vince1315  You'd probably have a easier time getting your crazy neighbor to move than finding an avenue for  a "sit down" with an Airbnb decision maker😏

 

Suggest you research listing on other platforms which are more host-friendly.
