I received a notice from Building Management that the property is illegally sublet

The notice says the Host was ordered to cease subleasing the property more than 30 days before I moved in.

 

I contacted the host for a refund, but he says the the agreement says the property was non-refundable. He says it is "safe" for me to remain in the property. However, I was told by the Building Management that subleasing is NOT allowed. 

 

I have contacted customer support but I would like to escalate this some how. They are trying to "work with the host", but that is not a viable option. When the host was served a legal notice well before I moved in, the property should have been withdrawn and my money returned immediately. 

 

I do not want to continue to do business with a host that is being financially rewarded for illegally offering a property. Airbnb should have no tolerance for this. I should not be financially obligated for a property that was misrepresnted.

Thank you Jenny. I received a call from the host saying he has permission for us to remain in the property so he will not refund any of our money. However, I spoke to the Building Manager again and was informed that it is illegal to sublease the property. 

 

From a consumer protection perspective the building cannot evict us, but I am not comfortable staying in a place that is not legally being offered.
