"Available for public occupancy"

Is a rental considered "available for public occupancy" if the public can't just walk in off the street but guests have to be screened before booking?

@Terri129 This would depend on how 'Available for public occupancy' is defined in the law or statute where it is used. Assuming it is not defined than a layman's view  (ie mine) is that an Airbnb listing is available for occupancy by the public so I would say yes it is.
