Glitch? Profile photo required but guests can instant book without it

I have instant booking enabled and I require that guests have a profile photo. 

Yesterday, the guest instant booked without it. 

Airbnb says I can cancel penalty-free by myself but it will count as one of 3 penalty-free cancelations.

Why?

Those 3 cancelations are there for when the host feels uncomfortable with the guest or that they are going to break his house rules, not for Airbnb technical glitches.

PS ..... the guest has no photo at all... not even the flower, dog, cartoon... nothing.
