Photo content not the hosts property

Should a host be allowed to include content of a neighbors property in their advertising ..

Well it disappoints me that some else’s back yard gets photographed and it content and used for neighboring Airbnb pictures and publicly ... 

i understand that yes one guests arrive they will see it  but until that point I see it as a breach of privacy and feel that Airbnb should have strict regulations regarding these issues .. 

I don’t put pictures of their backyards in my Airbnb publicity and their cat , dog ..??? 

This should be stopped ..

@Joyce246 Other Airbnbs in my surrounding have full pictures of my house because that is the view their tourists will get, I guess i never saw it as a breach of privacy. If it bothers you a lot, you can always contact them, I am sure they will be reasonable enough to remove them in order to maintain good relationship with you as a neighbor.

Strictly speaking it is illegal because it is private property, unless you have signed a property rights form to license usage.

It isn't I'm afraid, @Ange2. There are no laws to stop you taking photos from your own garden/window of what you can see outside. Likewise, when an estate agent/real estate photographer takes a front-on photo of your house, the neighbouring properties are also included.   

@Gordon0  Using a view of private property that is not publicly accessible (like a backyard) and for advertising  purposes, which @Joyce246 said it was,  is a different matter.  At least that is what lawyers have always told me.

Get yourself a new lawyer, @Ange2. Until we see this photo, it's impossible to provide an accurate response. 

@Gordon0    True, seeing the photo is the only way to make a determination of violation. Hence,  strictly speaking.  But including private property, without license, particularly for advertising purposes  is stated as a definite no-no  in every legal contract I have with photo agencies and magazines—erring on the side of caution.
