Squatters in Houston Texas

Hi there!

 

There is an infestation of squatters that seems to be happening in several states. Covid has displaced so many people and it's becoming more and more desperate every day for so many people.

 

I'm wondering about the legalese & protocols of this, in the State of Texas (Houston)..If an Airbnb guest's time is up after a 30 day stay, or I guess with any 30 day short term rental IE; when they become technically "contract-less"..can that guest on the 30th or 31st day of move out,  claim something called "tenant's rights" or can they be removed then and there for trespassing if they do not leave or does an eviction need to happen? If so and if that is necessary..when should the eviction process begin if the checked in guest is showing signs to be a squatter? Also, this is regarding a property where the host is also hosting in their private home. Thanks for any and all advice!

Yikes! That sucks. Fortunately for me I have a warden in the family and two sheriffs down the street that can help me. For you... I would call the police or a warden (Wardens have higher ranks than police do) and tell them you suspect something of concern so they can bring the individual out, take the key and have the police/warden monitor you bringing their things out of your space and have them escort them off your property. Make sure you have the AirBnB contract (booking dates) to show that they are supposed to leave and they are not. As to your squatter question... I would start limiting your length of stay time, nothing longer than 7 days just so that you can prevent a lengthier stay and have a potential squatter.

In California, a guest can claim to be a tenant after 14 days or if they receive Mail/ supplies or move in an article of furniture.  It’s best to give 3 day notice and file the eviction ASAP as I’m going through this nightmare now.  The squatter went to law school and is purposely abusing the system.
