Just found out that beginning JUNE 1st 2023 on Long Island, in Suffolk County NY USA, the Townships and counties have begun charging a 5.5% short term occupancy tax on rentals less than 30 days on ALL RENTALS Within the county. I have 1 link I will post here, the only article my accountant could find. There is no information on this, No News anywhere. Our elected officials have no info on how Airbnb hosts can make sure they are following the law.
I just added my tax info & used my SSN for both tax ID number requests to have ABB charge and collect 5.5% room tax on anyone who reserves 29 days or less. I also wrote to the few short term guests I have had the pleasure of knowing & asked them to voluntarily send me the tax due on the amount I received. not the amount they paid. I hope I did this right and I hope my guests all send me the tax.. I did not do an official "request money" yet. I asked voluntarily hoping that those few will "send money" to me thru the the ABB site. They were all such wonder human beings.
Does anyone else collect this new tax yet? The only link found was sent to me by my accountant & is attached here. and is attached.

Did a Long Island Group from in response to this new tax? Haas anyone registered or started collecting taxes? Just found out about this after the renal "season"- do you start collecting taxes once you register? What about taxes from past guests?
Hi What I did:
1) I registered with the Comptroller online and got a confirmation email that I was approved.
2) They sent a form to fill in for the 3rd Quarter Taxes.
2a) I made 3 copies of the form, whited out the Quarter Date info
3) I filled in the three forms from when I began short term which was this year in march 2023.
4) I included the 10% late fee and the 1% per month late fee on each form
5) I wrote a separate check for each quarter with a note of explanation and a request to give me a 1X reprieve on the late fees.
6) I mailed it at the USPS with a proof of mailing on 9/19/23. Due every 3 months by the 20th, but says 20 days grace.
Hope this helps.
I thought short term rentals on Long Island weren't allowed? I thought only midterms ( 30 day plus). Can you confirm? I'd love to do this! Looking out of state currently-
Thanks!
Suffolk county has no problem with Rentals less than 28 days, BUT Each Township is handling things differently as their constituents are swaying the making of additional rules. Brookhaven town is going to pass a law that does not allow rentals of less than 28 days UNLESS you are an owner occupied room rental that is not single and separate, a Bed and breakfast or hotel motel with existing permit. here is the law being voted on in March 2024. There is a group online that is hoping to force the town to reduce transient to mean less than days.https://www.brookhavenny.gov/DocumentCenter/View/31457/Introductory-Local-Law-6-of-2023-PDF .
yes the county was very quick to send the threatening letter and has not followed up at all with getting the dopey "portal" to function. they also waited more than a full month to deposit the first check i sent. nobody picks up the phone at the number listed in the threatening letter BTW. when i initially did get through to somebody he, at least, confessed that no one over there had any ideal what the hell was going on. A person who answered the phone when I recently called the comptroller's office said that the form will again be mailed. I added the tax info into the airbnb machinery and it is automatically tallied into prospective guests fees going forward. of course bookings that were set up before the threatening letter required being payed out of pocket. I doubt they are able to check to see if everyone is submitting all the correct amounts but just to avoid worrying about it i'm playing it straight. I also posted the "certificate of authority" thing in the guest room as directed.
Noelle, I sent back to when I first had short term rentals & changed the form date to the proper quarter. I sent them money, they sent me a Certificate of Authority and I hung it on my Front Door next to my permanent certificate of occupancy.
We need a Long Island Host Support Group!
Ill do it. Im in Suffolk County between Port Jeff & Stony Brook
Candysue0, did you ever set up a Long Island support group? I'm in the South Setauket area. Is there a way now to have Airbnb charge the 5.5% tax? From what I was told when I called them, it was up to the hosts to collect after booking until they thought it worth while to program the availability to do so in our area
- which I think is totally ridiculous!!!
Hi Karen,
There are quiet afew groups on Facebook already so I have been posting there. As far as collecting short term rental, I explained how I am doing it in previous posts on this thread. I am owner occupied. Brookhaven just streamlined the process for owner occupied apartment approvals, but they have not said anything about simple room rentals/house shares.
