My guest won’t leave

I rent my place when I go away. My guests are meant to leave by 11am and it’s now 8pm and I’ve arrived home and they are still here. I’ve asked for them to go but instead they don’t move and speak in French. It’s me and two guys and I don’t know what to do. I’m worried if I threaten to call police they will get angry. What do I do???

"8.2.2 You agree to leave the Accommodation no later than the checkout time that the Host specifies in the Listing or such other time as mutually agreed upon between you and the Host. If you stay past the agreed upon checkout time without the Host's consent (“Overstay”), you no longer have a license to stay in the Accommodation and the Host is entitled to make you leave in a manner consistent with applicable law. In addition, you agree to pay, if requested by the Host, for each twenty-four (24) hour period (or any portion thereof) that you Overstay, an additional nightly fee of up to two (2) times the average nightly Listing Fee originally paid by you to cover the inconvenience suffered by the Host, plus all applicable Guest Fees, Taxes, and any legal expenses incurred by the Host to make you leave (collectively, "Overstay Fees"). Overstay Fees for late checkouts on the checkout date that do not impact upcoming bookings may be limited to the additional costs incurred by the Host as a result of such Overstay. If you Overstay at an Accommodation, you authorize Airbnb (via Airbnb Payments) to charge you to collect Overstay Fees. A Security Deposit, if required by a Host, may be applied to any

Overstay Fees due for a Guest’s Overstay."

@Catherine1845 @Please also call Airbnb and document this from now. Get them to deal with the situation and earn their “admin fee”. Good luck to you.

Call the police. It's the right decision. Tell the police you feel threatened. 

 

The guys don't need to know you've done till the police arrive.

 

Police will ask the guys if they have a contract, and when they say no, other than a short Airbnb stay,

police will escort them from the flat.

@Catherine1845  You don't "threaten" to call the police if you feel in danger, you just do it. If you don't feel in immediate danger, call Airbnb first and they will call the guests and tell them they have to leave. If you do have to call the police, make sure you have the reservation information handy to show them that the guest's booking was ended this morning and at this point they are simply trespassing.

And call a friend or relative to come over and hang out with you until these guys are gone.

Can I ask which avenue you used to make this happen?

I hope it didn't take too long.

Did they have a "reasonable excuse" to be there longer than check out time?
I do know sometimes people forget what the time is in a different place but when you are basically a hop, skip & jump away it's a bit different.

Well when I probably asked them to leave like 15 times nicely and they just kept ignoring me and speaking in French. And asking me where the guy was meant to stay. I think what happened was he had booked my accomodation Friday to Sunday but his flights were Saturday to Monday but he realised too late and didn’t want to pay for an extra night. The issue is I live in the flat when I don’t have guests so it wasn’t an option for them to stay and I don’t want two random guys staying especially when the flat would no longer be covered outside of air bnb insurance. 

 

I ended up asking a friend over to help and said they really had to go now which they finally did with no apology or anything.
