NJ passed ANOTHER law regarding collection of sales and occupancy tax by online marketplaces. It is now officially clear that AirBnB MUST collect and remit the state sales and occupancy tax on every booking in NJ. When is AirBnB going to implement the tax collection in NJ.
Here is the relevant section "Notwithstanding any other provision of law or administrative action to the contrary, transient space marketplaces shall be required to collect and pay on behalf of persons engaged in the business of providing transient accommodations or hotel rooms located in this State the tax for transactions solely consummated through the transient space marketplace. For not less than four years following the end of the calendar year in which the transaction occurred, the transient space marketplace shall maintain the following data for those transactions consummated through the transient space marketplace"
That's how I read the new rules as well, that it has to be seen as a separate line item, which means that airbnb/software has to manage it, so I have no idea what the tax implications are going to be for 2018 since airbnb isn't collecting this tax. For a company that is beseiged by anti-short term rental regulations at the local, state and even national levels, their public affairs/government relations is shockingly poor.
Greetings all. I am also wondering why this tax has not yet been tabulated on the Airbnb site. VRBO is collecting it now (as well as an additional 2% local city tax..which in my case in Cape May NJ has not been passed..just the 11.6% State tax). There is a FB page of folks if you google it..who are trying to fight this NJ tax. The realtors typically charge 15% and are exempt from collecting additional tax - from what I can see. I am really hoping that this tax is reversed...there are NJ Bills that have been proposed but nothing so far has been finalized.
