Too many guests

I had a question that maybe someone can answer. I have a two bedroom condo, HOA only allows 6 people in a my condo. I post several times in the descriptions of the condo. I had a guest inquire about my condo and said she had six people that would like to stay there. I confirmed her and she accepted. A week before check-in I ask for a list of the guests names so I can register with HOA and get approval. She sent me a list with seven people on it NOT including herself! I text her back and reminded her only six were allowed. She said sorry and that two people were just going to visit. She sent me a revised list with six people including herself. At check-in there was 6 people. Then  proceeded to sneak the other two people in! The security guards caught them, I was called and I confronted her in a text she said no that there was only 6 people there. I got a fine of $100 a day but I didn't know that until I got my bill at the first of the month. Since she broke the contract, could I have ask them to ALL leave? and what do I do to let Airbnb know what happened.

Yes you could of asked them all to leave, the guest broke the house rules, contract null and void.

 

You don't have to accept 'two people have gone so it's ok now' or any such nonsence, if you pre-warned them (and in this case twice) the guest has no come back, and if you  have security in the building to confirm it, airbnb has to support you.

 

That said in future if you get an inkling that a guest wants to try this, be clear and tell them the building has security and there is a fine for extra's, which you will pass on to them, as well as kicking them out. Either guests will take the hint and stick to 6, or book elsewhere, or they they pay up (last resort)

 

If you have a deposit on your listing, start a claim with airbnb, show the communication pre-warning the guest about numbers, and the fine from security. They should give you a payout (should, not 100% guarenteed if the fine wasn't prewarned in house rules). It might take a while though.

Also make sure all communication is via the airbnb app, it'll help in future, not texting.

My HOA allows 6 people total - they don't care how young or old.  However, Airbnb doesn't count infants and has allowed reservations for 6 people plus an infant which completely violates my HOA rules.  I have instant book on and it noted in the description.  Any suggestons on best way to handle this so it doesn't continue to happen?  I have just overlooked those times and hoped for the best, but it could easily become a problem for the guests and us as the owners.
