Will I get charged a penalty

I got numerous inquiries for dates that are either booked already w/ the client asking us to let them know if those dates become available. This is when I get confused because I want to respond immediately but I also don't want to decline(though I have to) in fear of losing our ranking in search. When I do eventually decline, I put the proper reason either spam or inquiry about different dates than requested.

Can anyone clarify if i will get penalized?
