I am a landlord of a condinium in Montreal whose tenant did not request permission to airbnb my property, which led to me receiving a $650 fine and was in strict contravention of 1) our lease aggreement and 2) the condo rules which my tenant was provided.
How does airbnb protect owners, like myself, and what to they do in cases like this where laws and been broken to their benefit?
How do I file a complaint so that this does not happen again?
@Sarah1006 hm... I think you should cancel your lease contract with your tenant and evict him from your property. Once he would get out he will cancel his Airbnb listing too. If not, you can contact Airbnb and ask them to remove it... but it will take time I am affraid.
you should also charge your tenant $650 fine from his security deposit or else because it is his fault.
Airbnb is not asking for any proof of ownership of the property, it is all about trust, so you are not the only one affected.
I am not the lawer and not familiar with the law in your country but this is what I would do.
@Sarah1006 You need to file a complaint against your tenant with your local court system. I'd recommend serving them with an immediate eviction notice, and charging them for the fines you've encountered.
On a positive note, your property is in Montreal, not Miami Beach.
I think you should ask the Régie du logement to help you way before airbnb. The projet de loi 67 has many flaws but with cases like this, it's easy to apply.
