Minneapolis sales tax and permits for airbnb

Does anyone know what the city of Minneapolis requires for airbnb sales tax collection and permits?

Yes. To get a Bed and Breakfast permit from the city you have to be zoned for R3 and above. You can check your zoning Here. You also have to meet the standards set out in Chatper 536 of the zoning code. Scroll down to Bed and Breakfast. Here. If you don't meet either of these requirements you will have to risk putting it up on Airbnb without a permit. You will probably be safe, the city doesn't seem interested in cracking down on unpermitted BnBs right now.

 

For tax collection, you apply for a Minnesota State Tax ID Here. You can report your earnings and pay your sales taxes online.

Update: The city of Minneapolis has changed their permitting process. Depending on your circumstances, you may not need a permit anymore. See their website for details

With recent changes to the taxes, I have this request in to Air BnB ... I will update as I find out more:

 

I just reviewed the Sales Tax collection process for Minneapolis, MN. I'm just clarifying that AirBnB is collecting and paying out the MN tax. I'm assuming this because per the state's "cheat sheet": WHEN: "The residential property is located in Minnesota and the owner uses the services of an accommodations intermediary to facilitate all sales of lodging at the owner’s property." ... THEN: The accommodations intermediary must register as a retailer to collect, report, and remit taxes on the full sales price of lodging and related services."

 

I do understand that *I* am responsible for collecting and paying any Minneapolis-specific sales tax.

 

I am not quite sure where to find that Minneapolis-specific sales tax amount, but I'm looking!

We currently do not collect any taxes for Minnesota. However, we are constantly trying to update our site to make it mroe user-friendly and streamline the tax process. 

While we currently don't have an agreement with your state's tax authorities, we are working towards expanding the locations in which we collect them for. 

For the time being, since we do not collect them for you, you will need to collect them yourself. To do this, you state it in your listing description, along with the amount or percent and once someone books, you will send a Resolution Center claim for those funds. Hi Betsy,

Just wondering if you are using the Resolution center for MN State sales tax collection and if so, how its working for you and how the process works.  Not sure if I should do that or just pay the sales tax myself out of my earnings.  Thanks for any further input!

 

Now that Air BnB is collecting sales tax (as of Oct 1, 2018) Where is it listed in our listing? Are we as host required to list it on our site? If so, where do we do it>

Does Air bnb list it? Need further clarification

This is what MN mandates for state tax (from the newish state laws):

 

Residential property rental facilitated by an accommodations intermediary


An accommodations intermediary that facilitates the sale of the short-term rental of
residential property located in Minnesota must register as a retailer to collect, report, and
remit the taxes on the full sales price of lodging and related services. This is true
regardless of the location of either the person renting the lodging or the accommodations
intermediary (whether located in Minnesota or not, and whether located in the same local
jurisdiction as the property or not).


Facilitating the sale of lodging includes "brokering, coordinating, or in any way
arranging for the purchase of or the right to use accommodations by a customer." Thus,
facilitating the sale of lodging includes collecting receipts from the customer of the
lodging and transmitting the receipts to the owner of the residential property, whether this
is done directly by the intermediary or indirectly through agreements or arrangements
with third parties, and whether or not the accommodations intermediary deducts or causes
to be deducted any fees or other amounts from those receipts.


Facilitating the sale of lodging does not include mere advertising of the availability of
the residential property for short-term rental, which directs the customer of the lodging to
contact the owner of the property to reserve and purchase the lodging.

Of course Mpls most likely has city taxes as well. We called the city (of St. Paul) with numerous questions when we learned of the license requirement and they were very helpful so we recommend doing the same for your city.

as OF Oct 1s, 2018, Air BnB is collecting MN sales tax from our listings. Where is this documented for our guests? Do we have to add it to our site? If so, where. I have scoured the site and can't seem to find a space to add it to my listing so that it is added to their rate.

Did you ever find an answer to this? The following link appears to indicate that guests will be charged MN sales tax when they book. We recently reopened our listings after taking a break for a few months. I don't see sales tax listed on recent 2019 bookings, so I'm wondering if it appears on the guest's statement, but not on ours.
