Fraud Possibility

I had a guest who check in at 1530hrs and then reservation was cancelled at 1727hrs local time, but the guest was still inside the apartment whilst the reservation status was Cancelled.

 

The Guest did not vacate the apartment until 3hrs AFTER the reservation was cancelled.

 

He may have only vacated, as he saw me coming towards the apartment, else this guest would have got away with staying for FREE without paying for Airbnb and Hosts fees.

 

Is this legal or breach of Airbnb terms of service?

From what I can see your cancellation policy is set to "strict".

Was it set to "strict" when the guest booked?

If it was, then I think the guest will not be refunded. See this link ... cancellation_policies#strict

 

If you recently changed it to strict then the policy in place when they booked is what counts.
