I have a long term guest requesting to extend another month or two. I'm a little nervous

Has anyone in Oregon had a long term guest stay and refuse to leave? So far the stay has gone well, however, I don't know what the guest's rights would be if he wants to keep staying on. Should I rent to him in 2 week increments at a lower rate to protect us from not being able to evict if we wanted the house back to ourselves? Is there a lease agreement anyone has or does bnb have leases? I almost rather the guest depart and return than stay on long term due to being nervous about how difficult it would be to terminate the arrangement.

You already know the answer, a 2 week booking would be perfect for you and the guest, you might hate each other after a week lol. If you get on together then consider a longer booking.

@Pamela247, you can establish a rental contract parallel to the airbnb agreement, only you cannot add other terms nor restrictions, that have not been disclosed before booking. 

As he is already here, you could discuss, what his plans are, how long he is staying in the region etc. You should get an idea of the risk involved. The limits for long term stay becoming permanent lease vary. In my country, it’s 90 days, therefore we limited it at 45, with rare extensions possible, but always under the limit. In your place, it could be 30 days, so look it up online. I would stay under that. You should not extend the first stay over the limit and not add a consecutive contract.

if the guy is a guest to keep, I would send him a special offer with a day in between and book that day via a friend at 20 bucks. With review. You can always let the guy stay on, but legally, he can’t proove it. To send him away for the night would be preferable. He may wish to visit his fam8ly during a weekend anyway and if he gets a better rate or a refund for one or two nights, he might love the idea. I would prefer to lose a few dollars and not bear the risk of gaining a permanent family member.

I have had this happen. My stays are now reduced to 22 days. If a guest wants to stay longer, he/she needs to check-out for at least one day. If the guest stays longer than 28 days he/she automatically gets tentant's rights. Bottom line, they have to check-out and then check-in again but not on the same day.

This is the point where it would be best to have your agreement in writing with a specific move-out date.

Renew the lease formally if he wants a new move-out date.

Discount your rate ONLY if he signs an agreement.

You are right to feel nervous.

Eviction is easier after a written contract has lapsed, you have timeley given written notice of his last day of tenancy and you refuse to extend your contract.  Eviction is more difficult when you have an unwritten agreement. Many cities will construe continually extending airbnb agreements as true long term tenancies which may give tenants many more rights.
